A Nevada woman recently filed a Zimmer Durom cup lawsuit against DePuy, alleging the popular hip implant device was defective and caused her to suffer from serious complications, including metallosis.
The plaintiff, Tacsonia B., says she was implanted with a Zimmer Durom cup in her right hip on Nov. 6, 2006. Unfortunately, in the years following implantation of the device, Tacsonia says she began suffering from pain and loss of function in the area of her implant. She alleges she was eventually diagnosed with metallosis, a kind of metal poisoning, in March 2016.
In response to these injuries, Tacsonia turned to litigation, alleging in her Zimmer Durom cup lawsuit that she was not adequately warned about the risk of metallosis and other complications associated with the Zimmer hip implant device. Had she been warned, she claims, she would have chosen a safer alternative.
Tacsonia filed her Zimmer Durom cup lawsuit on July 30, 2018, in the U.S. District Court for the District of New Jersey. The lawsuit was filed on multiple counts, including failure to warn, design defect, manufacturing defect, negligence, breach of express and implied warranties, constructive fraud, and several others. Tacsonia’s husband, Keith, also filed on one count of loss of consortium.
The Zimmer Durom Cup Device
The device at the heart of this lawsuit is the Zimmer Durom cup, a component of the popular Zimmer hip implant device. This implant is a metal-on-metal hip replacement, composed of cobalt and chromium metals. The Durom Cup component is made as a permanent fixture, to be kept in place as the bone grows into the cup’s shell.
The device’s manufacturer, DePuy, markets the Zimmer Durom implant as safe and effective. A growing number of hip replacement lawsuits, however, allege that the company is aware of a link between the device and a number of serious hip implant complications, including metallosis, device loosening, and a high rate of failure.
Filing a Zimmer Durom Cup Lawsuit
More and more patients are filing lawsuits against DePuy over complications associated with its Zimmer Durom cup. According to litigation, the device’s manufacturer failed to adequately warn the public and the medical community about the serious side effects linked with the device, including metallosis.
Besides the Zimmer Durom hip implant, many other hip implants have also been connected with significant complications. Indeed, other DePuy implants, including the Pinnacle hip device, have also been linked with serious risks, and have brought on their own onslaught of lawsuits. Australia has even taken the Pinnacle hip device off their medical market entirely, because of reports of side effects.
