A settlement has been reached in a class action lawsuit alleging Stream Energy Pennsylvania LLC and others misled consumers about its variable rate electricity plans, including the rates and the amounts charged.

If you were enrolled as a Stream Energy Pennsylvania customer and were enrolled in its variable rate electricity plan from June 1, 2011 through May 31, 2018, you may be entitled to benefits from the class action settlement.

Plaintiff Steven Basile filed the Stream Energy class action lawsuit in June 2015. He alleges Stream Energy promised customers savings on their energy bills if they switch their energy suppliers to Stream Energy.

“However, despite these promises, a Defendant Stream Energy customer may end up paying in excess of 50% more for electricity than what he or she would have paid if he or she had not converted to Defendant Stream Energy,” the Stream Energy class action lawsuit states.

“Instead of benefitting from switching to Defendant Stream Energy, a typical customer loses hundreds or even thousands of dollars per year.”

According to the Stream Energy class action lawsuit, Basile signed up with Stream Energy because he thought he would save money on energy costs. He says he was initially placed on a fixed rate contract for a one-year period, but that after the year passed, he was switched to a variable rate plan and subsequently had significantly higher energy bills.

Basile alleges Stream Energy misleads its customers and that, as a result, its customers ended up paying far more for energy than they otherwise would have paid. The Stream Energy class action lawsuit asserts claims for breach of contract, breach of the covenant of good faith and fair dealing, unjust enrichment, and violate the Pennsylvania Unfair Trade Practices and Consumer Protection Law.

Stream Energy denies the allegations but agreed to settle the variable rate electricity plan class action lawsuit to avoid the burden and expense of ongoing litigation. The Stream Energy class action settlement was preliminarily approved on May 31, 2018.

Class Members who would like to opt out of or object to the Stream Energy settlement must do so no later than Aug. 14, 2018.

Who’s Eligible

Class Members include anyone in Pennsylvania who was enrolled as a customer of Stream Energy Pennsylvania and were on its variable rate electricity plan at any time from June 1, 2011 through May 31, 2018.

Potential Award

Varies.

Time Period 1: If you were on Stream Energy’s variable rate plan at any point between June 1, 2011 and Feb. 28, 2015, you will receive a payment in the amount of 5 percent of all amounts you paid to Stream Energy for service provided under the variable rate plan during this time period.

Time Period 2: If you were on Stream Energy’s variable rate plan at any point between March 1, 2015 and May 31, 2018, you will receive payment in the amount of 2 percent of all amounts you paid to Stream Energy for service provided under the variable rate plan during this time period.

    I have been with Stream Energy for over 3 years and have saved money every year. However I have renewed my agreement every year. If you have no intention of renewing your agreement do not sign up! They send emails and letters to inform you to renew. Remember these prices are agreements between you the local utility and Stream the 3rd party. All billing is done by the utilities and the bill is sent to the customer monthly. This lawsuit was a money grab by the law firm.?
