Plaintiff Frances S. alleges Zimmer either knew or should have known about the side effects that could cause patients pain and harm upon receiving the metal hip implant, but that the manufacturer’s failure to warn consumers put those users at risk of serious injuries.

The Zimmer metal hip complications lawsuit is seeking compensatory damages based on Frances’s argument that the Durom Cup implant she received was defective.

In her Zimmer metal hip complications lawsuit, Frances asserts claims associated with breach of warranty, product liability, negligence and breach of consumer fraud laws.

The device was marketed as allowing for better mobility, but plenty of patients who got the device report this is not the case. Some of those injured patients went on to file Zimmer hip implant lawsuits because of the problems and pain they suffered following implantation.

Frances claims the Durom Cup has been linked to numerous Zimmer metal hip complications, despite the representations in the company’s marketing material that allegedly said it would give greater range of motion and less wear on the bearing than more traditional hip replacement components.
