Golden Corral Corporation has agreed to pay nearly $4 million to settle a class action lawsuit alleging it failed to pay associate managers overtime when they worked more than 40 hours in a workweek.
If you were an associate manager trainee or an associate manager candidate employed by Golden Corral between March 13, 2013 and March 30, 2017, you may be eligible to receive compensation from the unpaid overtime class action settlement.
Plaintiff Robert Schriver alleges Golden Corral failed pay associate manager trainees overtime for training and were given a lump sum in lieu of overtime, which he says is a violation of the federal Fair Labor Standards Act and Ohio and Pennsylvania wage and hour laws.
The FLSA requires businesses to pay non-exempt employees 1.5 times their hourly rate for each hour worked over 40 in a workweek or eight hours in a single day.
The Golden Corral unpaid overtime lawsuit was initially filed as a class action lawsuit and an Ohio judge certified a Class of associate manager trainees and candidates employed by the restaurant chain. The Golden Corral class action lawsuit was later decertified in order to facilitate the case as a collective action settlement under the Fair Labor Standards Act.
Golden Corral denies any wrongdoing but agreed to settle the unpaid overtime class action lawsuit to avoid the burden, expense and uncertainty of ongoing litigation. The Golden Corral settlement was approved on May 31, 2018.
Who’s Eligible
If you worked as an associate manager trainee in Pennsylvania or Ohio between March 15, 2013 and March 30, 2017, you may be entitled to compensation from the Golden Corral settlement.
NOTE: You must opt in to the collective action in order to participate in the Golden Corral unpaid overtime settlement and receive payment.
Potential Award
Varies, depending on the number of weeks you worked as an associate manager trainee during the period covered by the Golden Corral settlement.

N/A. Claimants are asked to provide the Notice ID that was printed on the settlement notice that was mailed to them.

While we cannot yet provide you with an exact date as to when the settlement checks will be distributed and sent out, we estimate that that date would be sometime in October or November, pending the resolution of some administrative matters.

Hello I filed a claim form and mailed in the completed form that was sent to me it says in a reply the the checks would be out Oct or November and I called they said it would be the 15th of December has anyone received a check?

In Vancouver Washington the health dept shut the restaurant down because of health violations. The cooks were leaving the trash dumpster in the kitchen and there was garbage and trash all over the kitchen floor.
Is there any lawfirm that can help in a similar situation? My husband works in a restaurant with a signed offer letter stating he is W2 Hourly Non Exempt. He’s a “salaried” manager and his “salary” is based off him working 52 hours per week. However even when he works 60 hours he only gets paid for 52. This is at a large nationwide restaurant that is doing this to their hundreds of managers across the country.
How will you know if they received your papers and when will you receive a check?
