It was initially seen as a breakthrough device because it was the only non-surgical method of permanent contraception.

However, there may be more problems than benefits associated with the Essure device. Many patients have reported that they have experienced serious side-effects after having the Essure device implanted. Now, lawyers are investigating if Bayer could be held responsible for patient injury in an Essure device lawsuit.

Patients claim that they were not warned of these possible side effects before or after they were implanted with the Essure device. Thousands of reports of adverse patient reactions to the birth control have been filed with the Food and Drug Administration since its approval.

Essure was seen as an attractive form of birth control because it is permanent, non-surgical, and non-hormonal, and was advertised as an alternative to tubal ligation, also known as “tube tying.”

During the implantation of the Essure device, two flexible metal coils are inserted into the uterus and placed into the fallopian tubes (one coil in each tube). Tissue develops around each tube over the course of a few months, blocking conception.

To ensure that the procedure worked correctly and that a patient can no longer get pregnant, a patient who has been implanted with the Essure device must be evaluated by their doctor after three months.

Essure was approved in 2002 by the the U.S. Food and Drug Administration via a “fast track” approval process, because of the many benefits it seemingly provided. It was thought to be a positive alternative to surgical sterilization, and was believed to provide a faster recovery time.

Now, patients are arguing that during the “fast track” approval process, the Essure device was not subjected to sufficient testing before it was released into the market. Patients are claiming that Bayer was negligent in determining the device’s safety, and inso doing, exposed patients to injury.

Hundreds of Essure device lawsuits have already been filed, in which patients are attempting to hold Bayer accountable for patient injury. In the Essure lawsuits, patients accuse Bayer of misleading patients about the safety of the birth control, and of not disclosing potential dangers associated with the device.

Specifically, the patients who brought forward the Bayer lawsuits claim that Bayer should not be able to be shielded from liability, as it currently is because of the premarket approval it received from the FDA in the fast track approval process.

Now, lawyers are looking into the possibility of taking further legal action against Bayer to hold the company accountable for patient injury.
