A $5 million settlement has been reached in a class action lawsuit regarding the quality of water in the City of Hannibal, Mo., between September 2011 and February 2016.
If you are a current or former customer of Hannibal Board of Public Works that paid for or used water during that period of time, you may be entitled to compensation from the Hannibal water class action settlement.
Plaintiffs Oliver Latta, Vickie Brooks, Crystal Stephens and Christine Stolte filed the class action lawsuit against the City of Hannibal, Hannibal Board of Public Works and the Missouri Department of Natural Resources, accusing the defendants of failing to provide safe potable drinking water.
The plaintiffs sought relief including damages, injunctive relief, punitive damages, attorneys’ fees and costs.
The defendants deny the allegations but agreed to settle the Hannibal water class action lawsuit to avoid the cost, risk and delay of litigation.
Under the terms of the proposed Hannibal water class action settlement, the defendants agree to commit at least $5 million to investigate and implement water quality improvements such as replacing chloramination as a primary method of disinfection.
The defendants have also agreed to pay $205,000 to reimburse Medical Monitoring Class Members who submit claims for their out-of-pocket costs for a voluntary urinalysis for blood and urine cytology.
The Hannibal water class action settlement was preliminarily approved on June 13, 2018.
Class Members who would like to opt out of or object to the Hannibal water settlement must do so no later than Aug. 10, 2018.
Who’s Eligible
The Court has certified two Classes:
Rate Payer Class: Includes all current Missouri residents who were billed and paid for water provided by the City of Hannibal public water supply system at any time from Sept. 1, 2011 and Feb. 28, 2016.
Medical Monitoring Class: Includes all current Missouri residents who, for a minimum period of three years between September 2011 and February 2016, resided in Hannibal and drank and/or bathed in water provided by the Hannibal public water supply system.
Potential Award
Medical Monitoring Class Members are entitled to reimbursement of their eligible out-of-pocket costs for a voluntary urinalysis for blood and urine cytology administered before Oct. 23, 2018.
Proof of Purchase
Medical Monitoring Class Members must provide proof and supporting documentation for their out-of-pocket costs, such as a receipt, explanation of benefits or an invoice showing that the costs were incurred for a urinalysis for blood and urine cytology administered before Oct. 23, 2018.
