The makers of Zicam have agreed to pay $16 million to end a class action lawsuit over the effectiveness of the over-the-counter cold medicine.

If you purchased certain Zicam products between Feb. 15, 2011 and June 5, 2018, you could get between $6 and $11 per product from this class action settlement.

According to the Zicam effectiveness class action lawsuit, certain types cold remedies produced by Zicam LLC and Matrixx Initiatives Inc. were falsely advertised. Specifically, the plaintiff alleges that the companies diluted the active ingredient in the OTC medicine that promised to make colds go away sooner.

The products covered by the Zicam effectiveness class action settlement include: Zicam RapidMelts Original, RapidMelts Ultra, Oral Mist, Ultra Crystals, Liqui-Lozenges, Lozenges Ultra, Soft Chews, Medicated Fruit Drops, and Chewables.

Under the terms of the Zicam Cold Remedy class action settlement, those who purchased the products between Feb. 15, 2011 through June 5, 2018 may be entitled to reimbursement for up to five items without a receipt or more if the consumer can provide proof of purchase.

According to the motion for preliminary approval of the Zicam effectiveness class action settlement, “Under the Settlement, Class Members who submit valid claims will recover according to the average manufacturer’s suggested retail price (‘MSRP’) during the Class Period for each of the Zicam Products purchased.”

The motion also states that “This is an excellent result for class members compared to their likely recovery should Plaintiff prevail at trial. Indeed, Plaintiff calculated recoverable damages on an individual basis to be the purchase price of Zicam Products under a full refund theory. A recovery for up to five products without proof of purchase—and unlimited recovery for six or more products with proof of purchase—reaches or exceeds the maximum recovery Ms. Melgar, or any class member, could expect at trial.”

Under the terms of the Zicam class action settlement, the defendants do not admit any liability.

The deadline for Class Members to object or exclude themselves from the Zicam Cold Remedy class action settlement is Oct. 3, 2018.

Who’s Eligible

Class Members include “All purchasers of Zicam RapidMelts Original, RapidMelts Ultra, Oral Mist, Ultra Crystals, Liqui-Lozenges, Lozenges Ultra, Soft Chews, Medicated Fruit Drops, and Chewables in the United States from February 15, 2011 to the date of the order granting preliminary approval of the settlement.”

Note: The Zicam class action settlement was granted preliminary approval on June 5, 2018.

Potential Award

$6.16 – $11.53 per item purchased, up to five products (without proof of purchase).

Proof of Purchase

Class Members who are able to submit a receipt or other documentation proving they purchased the items covered by the Zicam class action settlement will receive the actual price paid.

Those who are unable to submit a receipt will receive the average manufacturer’s suggested retail price (MSRP) of the product for up to five items.

Consumers filing claims for more than five Zicam products must submit a receipt with their Claim Form.
