Lung Cancer and Asbestos Lawsuit Filed by Wis. CoupleA new lung cancer and asbestos lawsuit filed by a couple in Wisconsin claims that the husband’s lung cancer was due to his on-the-job inhalation of asbestos while working for both Beazer East and Cooper Industries.

Plaintiffs Jesse G. and Judy G. allege that while Jesse worked for Beazer East, Cooper Industries and U.S. Steel Corp., he was exposed to asbestos. During the years between 1967 and 2017, he worked for these and other various entities which allowed him to inhale and ingest asbestos.

The couple alleges Jesse was exposed to asbestos fibers contained in some of the products manufactured by the defendants.

It was not until 2017 that he became aware of the fact that he had been diagnosed with lung cancer and asbestos was to blame for his deadly condition. Jesse and Judy claim that Beazer East, Cooper Industries and U.S. Steel Corp. are responsible for his lung cancer and asbestos injury diagnosis.

The couple claims that when these defendants designed and made their products with asbestos, they knew it was a dangerous substance that presented serious threats to human health. The companies allegedly failed to provide warnings sufficient to protect the health of persons who handled these products.

How are Lung Cancer and Asbestos Linked?

Lung cancer and asbestos have been linked for decades. In fact, breathing problems associated with asbestos inhalation and deaths connected to exposure to asbestos have been noted for nearly a century.

Asbestos is mined and used commercially for its heat retardant qualities and the ability it has to be a flame retardant. Although its use has been severely limited in the United States in the last few decades, it still is found in many commercial buildings as well as in certain industries.

Asbestos is still commonly found in the shipbuilding industry, the military and in rail yards.

It is a mineral that naturally is produced in the earth and is mined for commercial use. Left undisturbed, asbestos is not dangerous. However, if it is disturbed, the tiny fibers that make up asbestos can be deadly to people who are near the asbestos disturbance.

If asbestos fibers are inhaled or ingested, they cannot be exhaled or expelled by the body. When they lodge themselves in the lungs, over time they can produce inflammation. This inflammation can cause deadly conditions such as mesothelioma (the cancer of the lining of the lung) or lung cancer.

Lung cancer and asbestos are not always linked. Lung cancer can be caused by other things such as cigarette smoke, exposure to radon gas, air pollution, exposure to radiation and arsenic. However, the link between lung cancer and asbestos exposure is significant.

If you work around asbestos, as Jessie did, the Lung Cancer Foundation of America urges you to “[m]ake sure you use all protective equipment provided by your employer and follow all recommended safety procedures.” If you have developed lung cancer or mesothelioma and suspect you were exposed to asbestos, consider contacting an attorney to evaluate any legal claims you may have.

Jessie’s Lung Cancer and Asbestos Lawsuit is Case No. 18-L-414 in the St. Clair County Circuit Court.
