US Coachways Inc. has agreed to a settlement worth $2.6 million to resolve allegations that the charter bus company sent marketing text messages to consumers without their prior express written consent in violation of federal law.
If you received an unwanted text from US Coachways between Feb. 6, 2017 and Aug. 7, 2017, you could get $30.31 in cash and a $101.03 voucher from this class action settlement.
Plaintiff Jessica Dipuglia filed the US Coachways class action lawsuit after allegedly receiving the following text message: “USCOACH: Download USC App $25OFF Promo ‘uscapp’ http://usc.am/iPhone or http://usc.am/Android. Text Stop to stop or Help for help. Msg&data rates may apply.”
Dipuglia claims she did not give her consent to receive texts from US Coachways which makes the advertising message a violation of the Telephone Consumer Protection Act.
The TCPA is a federal law that prohibits companies from telemarketing unless they receive the consent of the recipient before contact is made. The law further prohibits robocalls, advertising text message, and calls placed to numbers on the Do Not Call Registry.
US Coachways denies the allegations but has agreed to pay $600,000 in cash and provide $2 million in Coachways credits to end the litigation.
According to court documents, the settlement was reached with the help of an experienced mediator.
U.S. District District Judge Marcia Cooke granted preliminary approval of the US Coachways TCPA class action settlement on April 30, 2018.
“The Court finds the Settlement was reached in the absence of collusion, is the product of informed, good-faith, arm’s-length negotiations between the Parties and their capable and experienced counsel,” the judge noted in the order for preliminary approval of the settlement.
Class Members have until July 30, 2018 to object or ask to be excluded from the Coachways class action settlement.
Who’s Eligible
Class Members include all U.S. residents who received the following text sent by US Coachways between Feb. 6, 2017 and Aug. 7, 2017: “USCOACH: Download USC App $25OFF Promo ‘uscapp’ http://usc.am/iPhone or http://usc.am/Android. Text Stop to stop or Help for help. Msg&data rates may apply.”

$30.31 in cash and a $101.03 Coachways voucher.

The settlement Claim Form requires that Class Members provide the telephone number that received the unwanted US Coachways text message.
