A woman has filed a disability insurance benefits lawsuit against Unum Life Insurance Company of America, the largest disability insurance companies in the United States, alleging unfair long-term disability (LTD) benefits denial.
Plaintiff Sindy P. files the disability insurance benefits lawsuit in Missouri federal court against Unum. The lawsuit was filed in the U.S. District Court for the District Western of Missouri on June 26, 2018.
According to the disability insurance benefits lawsuit, Sindy is a resident and citizen for the State of Missouri. She says that she began employment with Enersys Delaware, Inc. on Aug. 14, 2006, working as a maintenance technician. Enersys provides its employees with a group welfare benefits plan that includes LTD benefits for eligible employees.
By Nov. 7, 2015, Sindy says she had become disabled. According to the disability insurance benefits lawsuit, she suffered from the following non-exclusive impairments and limitations: “left lumbar radiculopathy, L5-S1 herniated disc, chronic back pain, left shin and foot pain, limited core mobility, anxiety, depression, endometriosis, dermatitis, and psoriasis.”
She says these problems began to affect her in June 2013. After having undergone back surgery in October 2013, she began receiving short term disability between Nov. 12, 2015 and Jan. 6, 2016.
However, although she applied for LTD benefits in February 2017, her request was denied by Unum. Although Sindy claims she remains disabled, Unum continues to uphold its previous denial for LTD benefits.
The disability insurance benefits lawsuit was filed on a count of wrongful denial of benefits, breach of fiduciary duty, and procedural noncompliance.
Overview: Disability Insurance Benefits
Sindy’s complaint is one among many others like it. Thousands of consumers have filed disability insurance benefits lawsuits against Unum, accusing the company of unfairly denying their benefits.
According to Vault, in 2015, the company had more than doubled its net income to $867.1 million. Cash flow from operations that year increased to $1.2 billion. The company employs 100,000 employees in the U.S. and is one of the largest and most recognized employee benefits companies in the world.
As a Fortune 500 insurance company based in Chattanooga, Tenn., Unum has an extensive number of allegations being filed against them. Some allegations accuse the company of placing profits over patient health and safety through the unfair denial of consumer disability benefits, unreasonable delays in claim processing, and underpayment of insurance benefits.
A Regulatory Settlement Agreement was signed by the company in 2004 in association with 48 states due to their wrongful handling of long-term disability benefits. The settlement resolved issues exposed during an NBC Dateline and 60 Minutes segment regarding Unum’s allegedly unfair denial of benefits.
The company also entered an agreement with the California Department of Insurance in 2005. This was also based on their allegedly wrongful handling of long-term disability benefits.
The 60 Minutes segment that was aired interviewed former employees and physicians of the company. It featured a former physician who claimed he had been fired for refusing to cooperate with orders to deny rightful disability insurance benefits to consumers. The segment also showed former employees claiming that Unum’s work environment came with “intense” pressure to deny consumer claims.
