Over 14 Women allege Sexual Misconduct from Staff OBGYN Class Action USC Sexual Assault LawsuitA class action USC sexual assault lawsuit was recently filed by 15 former students of the University of Southern California, alleging the university failed to protect them from the abusive acts of one of their staff members.

The USC sexual assault lawsuit alleges a university gynecologist had used his position to molest and victimize thousands of women, and the university allowed him to do this by failing to take any protective actions on behalf of these women.

The USC sexual assault lawsuit names Dr. George Tyndall as the defendant in the claim, who had allegedly molested “hundreds, if not thousands, of women” under the guise of routine medical examinations.

The USC sexual assault lawsuit was filed two weeks after four unnamed women made similar sexual misconduct allegations against Dr. Tyndall in a state court class action, and after claimant Lucy C. filed a putative federal class action. Lucy’s claim seeks to represent all women who suffered molestation or other forms of sexual assault at the hands of Dr. Tyndall.

“Tyndall violated [patient] trust by causing physical contact, including in the form of sexual abuse, molestation, and unwanted touching, in violation of his female patients that was not for the purpose of providing medical care, but for the purpose of providing Tyndall with sexual gratification,” the class action USC sexual assault lawsuit states.

Overview of USC Sexual Assault Lawsuit

According to the class action USC sexual assault lawsuit, Dr. Tyndall had worked as an OBGYN at the University of Southern California for almost three decades. During his time there, he had reportedly examined patients with the help of medical assistants called “chaperones.”

The chaperones had reported Dr. Tyndall’s conduct to their superiors, but their concerns allegedly went unheard and he faced no consequences. Dr. Tyndall allegedly had a preference for students of Eastern Asian descent and had victimized students stemming back from the early 1990s.

One of these victims alleges Dr. Tyndall had conducted an inappropriate pelvic exam in 1991. According to the woman, Dr. Tyndall had stayed in the room while she undressed, said she was beautiful, and that she had an “attractive” vagina.

Another woman had a similar experience in 2005, in which Dr. Tyndall had made inappropriate comments and had taken photos of her genital area. According to the class action USC sexual assault lawsuit, women allege Dr. Tyndall had regularly used bare fingers in OBGYN procedures, and regularly inquired if a patient was a runner when conducting these exams.

Also named in the class action USC sexual assault lawsuit is the University of Southern California.

USC President C.L. Max Nikias has since been forced to step down from his position. However, according to the class action, on May 15, 2018, Nikias had sent a letter to the university that revealed the numerous complaints regarding Dr. Tyndall and that this conduct had continued for years, but had been allowed to persist because the complaints were reportedly managed by the USC former health center director.

The women involved in the USC sexual assault lawsuit are seeking damages against Dr. Tyndall, USC, and the USC board of trustees for numerous compensatory and punitive damages.
