Top Class Actions viewers are reportedly starting to receive checks worth as much as $94.55 from a class action settlement over alleged privacy violations by developers of certain apps available on the iOS mobile app.

The mobile apps named in the app privacy class action lawsuit include Foodspotting, Foursquare, Gowalla, Instagram, Kik, Path, Twitter and Yelp.

The Apple privacy class action lawsuit resolves allegations that the app developers violated users’ privacy rights and that Apple misrepresented the privacy and safety of its mobile devices.

According to the Apple class action lawsuit, Apple cooperated with the app developers and allowed their apps to secretly upload and store information stored in the Contacts app on iPhones, iPads and iPods.

Apple allegedly misrepresented to users that the information contained in their mobile devices could not be taken without their consent.

“Plaintiffs allege that, as a result of Apple’s conduct, Plaintiffs and millions of other people purchased iDevices reasonably believing that they were secure when, in fact, they are not, and then downloaded Apps, including the Apps manufactured by the App Defendants, and suffered the unexpected and unauthorized theft of their personal data,” the Apple app privacy class action lawsuit alleges.

 

 

The defendants deny the allegations and maintain that they did nothing wrong. However, they agreed to pay $5.3 million to settle the app privacy class action lawsuit and avoid the burden and expense of trial.

Class Members of the app privacy class action lawsuit include anyone who downloaded and activated certain versions of any of the following apps on their Apple mobile devices and activated the “Find Contacts,” “Find Friends,” or other similar contact-finding feature before mid-February 2012: Foodspotting, Foursquare, Gowalla, Instagram, Kik, Path, Twitter, and/or Yelp.

The exact versions and dates of installation that are covered by the Twitter app class action settlement can be viewed on the settlement page.

This app privacy class action settlement only resolves privacy claims against the defendants and does not resolve the misrepresentation claim against Apple.

The deadline to file a claim for the app privacy class action settlement passed on Nov. 10, 2017.

The Apple app privacy class action settlement received final approval on March 27. According to the settlement website, distributions will be made from June 1 through June 24.
