Those whose HIV status was disclosed by Aetna through a clear plastic window on a mailed envelope, may be entitled to money under the terms of a $17 million class action settlement.
The medical insurer came under fire after recipients of a letter regarding their prescriptions inadvertently disclosed their HIV status. The Aetna HIV status disclosure class action settlement will resolve allegations that the insurance company failed to properly protect the private health information of Class Members.
According to the class action that hit Aetna over the mailing, Class Members’ names, addresses, claim numbers, and prescription information, as well as information about their HIV status were visible through the envelope.
The Aetna class action lawsuit alleged that the statement “[t]he purpose of this letter is to advise you of the options…Aetna health plan when filling prescriptions for HIV Medic…” was visible through the window on the envelope.
The plaintiffs accused Aetna of negligence, invasion of privacy, unjust enrichment, and Pennsylvania laws protecting the privacy of HIV related information.
Under the Aetna HIV status disclosure class action settlement, the medical insurance company will pay $17 million to Class Members. Aetna denies all wrongdoing under the terms of the agreement.
Class Members have until July 31, 2018 to either exclude themselves or object to the Aetna HIV status disclosure class action settlement agreement.
Who’s Eligible
Class Members include “all persons whose Protected Health Information and/or Confidential HIV-related information was allegedly disclosed improperly by Aetna and/or Aetna-related or affiliated entities.”
Potential Award
$75, plus up to $20,000 depending on financial or non-financial harm.
Proof of Purchase
Claim ID and documentation of financial or non-financial harm.

They said that checks was sent out the end of December 2018. I have not seen anyone posted they got a check.
I’ll “ADD” my 2 cents to that !!!
I don’t have the envelop anymore, I burn it I was upset and hurt that it was on my kitchen table. I don’t have a number so I can claim
I moved after this happened and I never received a claim number where I live now. Who do I speak with about being added, I should be able to prove that I should be added to this claim

$75? Seriously? $75? And up to $20,000 if you prove financial harm? Seriously? What the heck! These folks should be able to sue individually for the SOCIAL harm this has caused them! I don’t care if they didn’t experience financial harm! That’s not really the issue here. Most people know their postman if they’ve lived at their residence for any amount of time. He / she now knows their HIV status & guaranteed he/she can’t wait to share that info! Any & everyone that came into contact with that envelope had the potential of recognizing the recipient’s name & now knows info about their health that they didn’t want them to know. HIV still carries quite a stigma and this is simply horrifying that Aetna would do this only to discovery that your only remedy is a class action with a $75 pittance! Truly disgusting!
