Biomet Inc. is facing a growing multidistrict litigation (MDL), consisting of product liability claims alleging serious Biomet hip replacement problems.

One of the most recent metal hip implant lawsuits was recently filed by a woman from Arizona, claiming she had to undergo rigorous medical treatment due to the Biomet hip replacement problems that had allegedly developed.

Plaintiff Phyllis A. had reportedly developed Biomet hip replacement problems soon after getting the Magnum metal-on-metal hip prosthetic implanted. Like many other patients, Phyllis says she opted for the Magnum metal on metal hip implant after discussing the option with her physician and reviewing the marketing materials provided by the manufacturing company.

Biomet Inc. reportedly assured Phyllis and other patients that the Magnum metal hip implants were safe to use, and did not mention any adverse Biomet hip replacement problems. With these benefits in mind, Phyllis underwent total hip replacement surgery on her right side on Feb. 26, 2003.

While Phyllis did not report suffering any initial Biomet hip replacement problems, it was not long after the surgery that her condition allegedly changed.

Overview of Metal Hip Implant Lawsuit

According to the metal hip implant lawsuit, Phyllis had consulted with a Bone and Joint Specialist in Arizona on March 25, 2004, after she began experiencing painful symptoms. The Biomet hip replacement problems she reported included resistance, popping, and a grinding sensation.

Even with these symptoms, the specialist allegedly advised Phyllis this was not unusual and that these mechanical symptoms were common. The specialist further advised that these issues were due to the soft tissue adjusting to the device in the surgical area, and that she should continue with her recovery exercise regime.

At all times relevant, Phyllis says she followed physician instructions and medical advice while recovering from the surgery. With the advice given to her, Phyllis continued to contend with her worsening condition for years until 2017.

According to the metal hip implant lawsuit, Phyllis was finally diagnosed with metal hip implant failure on Nov. 28, 2017, after revisiting the bone and joint specialist. Upon the metal hip replacement diagnosis, Phyllis had also been diagnosed with metallosis or blood metal poisoning and eventually had to undergo revision surgery.

Phyllis says she underwent revision surgery on Jan. 7, 2018, in which the surgeons explanted and replaced the failed Magnum metal on metal hip implant. According to the surgical notes, there had been a black tarry fluid in the hip joint that is often associated with metallosis, along with bleeding around the hip joint.

Phyllis opted to file legal action against the manufacturing company after discovering Biomet may have known about defects in their prosthetics. The metal hip implant lawsuit alleges the Biomet hip replacement problems Phyllis suffered were completely preventable, and that the company had failed to warn the public against the potential complications.

Phyllis states she would not have agreed to have the metal on metal hip prosthetic implanted, if she had known about the potential Biomet hip replacement problems.

Phyllis’ metal hip implant lawsuit is joining MDL No. 2391, where it will stand alongside other claims alleging similar Biomet hip replacement problems. Her Metal Hip Implant Lawsuit is Case No. 3:18-cv-00347-RLM-MGG, in the U.S. District Court of Northern Indiana, South Bend Division.
