Mesothelioma Cancer Lawsuit Filed by Son for Secondhand Asbestos ExposureA Colorado man has filed a mesothelioma cancer lawsuit against multiple defendants claiming that he was exposed to asbestos through the companies that his father worked for over a 20 year period of time.

Plaintiff Richard M. has filed this mesothelioma cancer against several defendants. He claims he was regularly exposed to asbestos because his father brought home fibers on his clothing after working for the companies named in this mesothelioma cancer lawsuit.

Richard claims he suffers from mesothelioma cancer due to asbestos exposure.

He says that his father, Samuel M., worked for many manufacturing companies from 1953 to 1974 including Peerless Boilers, General Electric, Viking Pump, Superior Boiler Works, Honeywell International, Aurora Pump Company and many others.

Samuel, Richard claims, came home from work while he was growing up, with asbestos fibers on his clothes. Richard was exposed to asbestos because of his father’s exposure and thus, as an adult, has developed and suffered from asbestos-related mesothelioma cancer.

What is Mesothelioma Cancer?

Mesothelioma cancer is a cancer of the lining of the lungs or stomach. Mesothelioma cancer is almost always caused by exposure to asbestos fibers. Asbestos is a mineral that naturally occurs in the earth and is not dangerous if left undisturbed. However, when asbestos fibers are disturbed, they can be harmful if they are inhaled or ingested.

It has been used for decades in construction and manufacturing industries as a flame retardant and for heat resistant products. There are strict regulations that govern the use of asbestos including protection for workers that are around it.

If a worker is not provided proper protection from asbestos fibers while on the job, he or she can ingest or inhale the fibers himself or herself. Additionally, these fibers can travel home on the worker’s clothing and may harm family members who handle the clothing of the worker.

Children and spouses of workers who work around asbestos are vulnerable to develop deadly conditions such as mesothelioma cancer. This type of exposure is called secondhand exposure.

Richard claims in his mesothelioma cancer lawsuit that his personal injuries were due to his “exposure to asbestos, asbestos-containing products, and/or equipment requiring or calling for the use of asbestos and/or asbestos containing products.”

Allegedly, Richard suffers from asbestos-related mesothelioma as a result of his exposure to “asbestos dust and/or fibers from said asbestos, asbestos-containing products and/or equipment manufactured, sold and distributed by the Defendants.”

Additionally, Richard claims that his father was regularly exposed to asbestos from 1968 to 1992 because of frequent work he performed on family vehicles. These mesothelioma cancer-causing materials consisted of brake pads, brake linings and clutches.

Richard is filing this mesothelioma cancer lawsuit on multiple counts including negligence, negligence against supplier defendants, strict liability, breach of warranty and gross negligence.

The plaintiff is seeking damages for lost past and future wages, physical and emotional distress, emotional pain and suffering, medical expenses and the impairment of his quality of life.

This Mesothelioma Cancer Lawsuit is Case No. 1:18-cv-01006 in the District Court of Denver County.
