Checks have been reportedly been mailed to Class Members of the California Synchrony Bank call recording class action settlement.

Top Class Actions viewers are starting to receive checks in the mail worth $36.31 from the Synchrony Bank class action settlement.

In August 2017, a settlement was reached over a California class action lawsuit that claimed Synchrony Bank recorded calls with clients, but did not notify them of the fact that they were being recorded.

Plaintiffs James Elias and James Kozik claimed that this practice violated the California Invasion of Privacy Act, one of the strictest of its kind in the country.

Under the settlement deal, Synchrony Bank was required to establish a settlement fund of $999,999, which was first used to cover service awards to class representatives, legal fees, and the remainder of which was distributed among Class Members who received a recorded phone call from Synchrony Bank between March 27, 2012 and June 16, 2017.

Allegedly, the bank recorded its debt collector phone calls without telling the called party that they were being recorded. Elias and Kozik claim that they received such phone calls, and were not notified of the recording at the beginning of the call, as is required by California state law.

During the course of litigation for the California Synchrony Bank call recording class action lawsuit, it was allegedly discovered that Synchrony Bank did indeed make a practice of recording debt collection calls.

Elias and Kozik claim that the California Invasion of Privacy Act establishes “two-party consent” for call recordings, prohibiting anyone, even businesses, from recording a conversation unless both parties knowingly consent to the recording.

In the case of business phone calls that adhere to the law, individuals are notified at the beginning of a phone call by a pre-recorded message that states that the call is being recorded.

The Act allows individuals whose calls were recorded without their consent to claim statutory damages of $5,000 per violation or triple the amount of actual damages. The law applies to both inbound and outbound calls.

In the California Constitution, the right to privacy is considered inalienable, and the state has a long history of passing laws designed to protect its citizens’ privacy. As technology has changed, new laws have been passed to protect California citizens’ rights even as access to information and recordings have increased with new technology.

The deadline to file a claim for the California Synchrony Bank call recording class action settlement passed on Oct. 24, 2017.
