If you filed a claim for the Wild Planet tuna settlement, keep an eye on your mailbox because you may soon be receiving a check in the mail!

According to our viewers, they are receiving checks worth $9.11 from the Wild Planet class action settlement.

The $1.7 million Wild Planet settlement resolves two canned tuna class action lawsuits involving allegations that Wild Planet Foods Inc. short-changed customers by underfilling its tuna products below the 5-ounce weight indicated on the tuna can label. The two Wild Planet canned tuna class action lawsuits were consolidated in April 2016.

According to the Wild Planet class action lawsuits, experts at the National Oceanic and Atmospheric Administration conducted testing in 2015 and 2016 which revealed that Wild Planet and Sustainable Sea brands of canned tuna did not contain the amount of tuna advertised on the label. The testing reportedly revealed that the actual tuna content of the Wild Planet canned tuna was about 30 percent less than the federally-mandated minimum weight.

The Wild Planet canned tuna class action lawsuit filed by plaintiff Ehder Soto asserted claims for breach of express warranty, breach of the implied warranty of merchantability, unjust enrichment, negligent misrepresentation, fraud, and violations of California’s Consumers Legal Remedies Act, Unfair Competition Law, and False Advertising Law.

Wild Planet has not admitted to liability on the alleged underfilling issue but agreed to settle the canned tuna class action lawsuits to avoid the burden and expense of ongoing litigation. The Wild Planet class action settlement was granted final approval on Nov. 27, 2017.

Class Members of the Wild Planet tuna settlement include U.S. residents who purchased a can of tuna under the Wild Planet or Sustainable Seas brands between Nov. 5, 2011 and May 12, 2017.

Under the terms of the Wild Planet settlement, Class Members could have received payments of up to $29 subject to a pro rata reduction depending on the total number of claims filed.

The deadline to file a claim for the Wild Planet, Sustainable Seas class action settlement passed on Aug. 25, 2017.
