Las Vegas, USA - May 23, 2012: The Four Seasons Hotel sign in Las Vegas, Nevada. The Four Seasons operates on the top floors of THEhotel building and opened in 1999.Last week, Four Seasons Hotels Limited was hit with a class action lawsuit over a data breach that allegedly compromised the personal information of customers who booked hotel reservations from Aug. 10, 2016 to March 9, 2017.

The Four Seasons data breach reportedly compromised customers’ names, email addresses, phone numbers, addresses, credit and debit card account numbers, their expiration dates and verification codes, as well as other private identifiable information (PII).

Plaintiff Edward Feinstein alleges that he was forced to take steps to protect himself from future loss as a result of the Four Seasons data breach.

“Indeed, all of the Class Members are currently at a very high risk of direct theft, and prophylactic measures, such as the purchase of credit monitoring, are reasonable and necessary to prevent and mitigate future loss,” the Four Seasons data breach class action lawsuit says.

“As a result of Defendant’s wrongful actions and inactions, customer information was stolen,” Feinstein alleges in the Four Seasons class action lawsuit. “Many of the customers who booked rooms at Defendant’s hotels have had their PII compromised, have had their privacy rights violated, have been exposed to the risk of fraud and identity theft, and have otherwise suffered damages.”

Feinstein says he is a long-time Four Seasons customer and, shortly after the data breach, his debit and credit card information was allegedly accessed by hackers. According to the Four Seasons data breach class action lawsuit, he has had to purchase credit and identity monitoring service to alert him to potential identity theft. He claims he is at continued threat of further harm related to identity theft as a result of the Four Seasons data breach.

According to the data breach class action lawsuit, Four Seasons utilizes the Sabre SynXis Central Reservations system to facilitate the booking of hotel reservations made by consumers through hotels, travel agencies and other booking services.

On June 6, 2017, Sabre reportedly confirmed that an unauthorized party gained access to account credentials of consumers who used Sabre to book rooms at Four Seasons hotels. Feinstein alleges the data breach was the result of Four Seasons’s failure to properly safeguard consumers’ personal data from unauthorized access.

Class Members of the proposed Four Seasons data breach lawsuit include anyone in the United States who booked rooms at any Four Seasons hotel between Aug. 10, 2016 and March 9, 2017. Feinstein also seeks to represent a Class of California residents who booked rooms at Four Seasons during the same time period.

The Four Seasons class action lawsuit asserts claims for breach of implied contract, negligence, violations of California’s Unfair Competition Law, violations of California’s Unfair Competition Law, negligence per se, breach of the covenant of good faith and fair dealing and violations of the California Data Breach Act.

Feinstein is represented by J. Paul Gignac of J. Paul Gignac Esq. APC and Bobby Saadian of Wilshire Law Firm.

The Four Seasons Data Breach Class Action Lawsuit is Edward Feinstein v. Four Seasons Hotels Limited, et al., Case No. 2:18-cv-03351, in the U.S. District Court for the Central District of California, Western Division.
