DHS Homeland Security data breach

TIMCO Aviation Services has agreed to pay more than $300,000 to settle a class action lawsuit alleging the company violated Class Members’ privacy rights by compromising tax data in March 2016 without authorization.

The plaintiffs alleged in their class action lawsuit that TIMCO, an aircraft maintenance company, was hooked by a phishing scam and disclosed employees’ W-2 information to unauthorized third parties. The plaintiffs accused TIMCO of violating North Carolina’s Unfair and Deceptive Trade Practices Act, invasion of privacy, and negligence.

The class action lawsuit also alleges that TIMCO failed to warn them about the breach in a timely manner.

TIMCO does not admit liability under the terms of the settlement, but will pay current and former employees whose data was compromised in the breach up to $250 and provide identity protection services.

The deadline to opt out of the class action settlement agreement is May 1, 2018.

Who’s Eligible

Class Members include “All current and former employees of Timco and its parent, subsidiary, or affiliate companies whose W-2 data was compromised as a result of the Data Disclosure which occurred on or about March 2016.”

Potential Award

Up to $250 as well as identity theft protection.

Proof of Purchase

If applicable, proof of a false tax return, tax transcript request, and/or out-of-pocket expenses related to the data disclosure.
