Frontier-communications

A $10.6 million settlement has been reached in a class action lawsuit that alleges Frontier California Inc. (formerly known as Verizon California Inc.) imposed unlawful late payment charges on California consumers.

If you paid a late payment charge to Verizon California or Frontier California for residential telephone service that was paid from Dec. 1, 2008 through Feb. 21, 2018, you may be entitled to benefits from the Frontier late payment charge class action settlement.

In 2007, the California Public Utilities Commission reportedly issued an order allowing certain telecommunications companies to offer services on a “detarriffed” basis and provide the services pursuant to a private agreement with its customers.

Under the terms of the Verizon California contract, Verizon imposed late payment charges of the greater of $2.50 or 1.5 percent for outstanding amounts of more than $20.

According to the Frontier California class action lawsuit, Frontier California violated consumer protection laws and other state laws by imposing late payment charges which the plaintiffs allege are “unconscionable, void and unenforceable” under California law.

Frontier California denies any wrongdoing but agreed to settle the late payment charge class action lawsuit to avoid the burden and expense of further litigation. The Frontier California class action settlement was preliminarily approved on Feb. 21, 2018.

Class Members who would like to opt out of or object to the Frontier California settlement must do so no later than June 21, 2018.

Who’s Eligible

Class Members of the Frontier California settlement include anyone who was assessed a late payment charge or an erroneous late payment charge by Frontier California or Verizon California that was paid between Dec. 1, 2008 and Feb. 21, 2018.

Potential Award

Class Members’ share of the settlement fund will be allocated based on the amount each paid in late payment charges between Dec. 1, 2008 and Feb. 21, 2018 divided by the total amount of late payment charges all claimants paid during this timeframe.

Current customers will automatically receive their payment as a credit on their Frontier California bill. Former customers who submit timely and valid Claim Forms will receive payment via mail or electronically via PayPal or Zelle. NOTE: If the amount owed is less than $1, payment will not be mailed; however, payment can be sent electronically if the claimant requested to be paid by PayPal or Zelle.

Proof of Purchase

Class Members must provide the Claim ID and Access Code listed on the official notice of the Frontier California class action settlement. If you do not have this information, you can still submit a Claim Form online but you must provide the telephone number for which you allegedly incurred late payment charges and other requested information.
