New York Alice + Olivia Unpaid Intern Class Action Settlement

Alice + Olivia LLC has agreed to pay $443,500 to settle a class action lawsuit over allegations it violated New York Labor Law by failing to pay interns minimum wages.

If you participated in an unpaid internship for Alice + Olivia at any time between Jan. 16, 2009 and Jan. 16, 2015, you may be entitled to benefits from the wage and hour class action settlement.

The plaintiffs allege Alice + Olivia violated New York Labor Law by failing to pay its interns minimum wages. They seek to recover the allegedly unpaid minimum wages on behalf of themselves and other unpaid interns. Their Alice + Olivia class action lawsuit also seeks interest, attorneys’ fees, costs and other relief.

Employers are required to follow the federal Fair Labor Standards Act and any applicable state laws when it comes to paying their employees. These laws govern rates for minimum wage and overtime pay, meal and rest breaks, and rules designed to protect workers.

Some employers attempt to skirt minimum wage laws by recruiting unpaid interns to work for them. Although unpaid internships are not illegal, employers who use unpaid interns must ensure the internships meet certain factors or risk being found liable for violating the applicable wage and hour laws.

Alice + Olivia denies that it violated the law or that it owes any wages to the interns. However, it agreed to settle the unpaid internship class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members who would like to opt out of or object to the Alice + Olivia settlement must do so no later than April 23, 2018.

Who’s Eligible

Class Members of the Alice + Olivia unpaid internship settlement include anyone who participated in an unpaid internship for Alice + Olivia in New York sometime between Jan. 16, 2009 and Jan. 16, 2015.

Proof of Purchase

When filing a claim, Class Members must complete and enclose a Claim Form and Release, IRS Form W-9, and a copy of a government-issued or college ID. Unverified Class Members must provide additional proof of internship, such as company correspondence, an offer letter, photograph, or email concerning the Alice + Olivia internship.
