DISH Network LLC has agreed to pay $2.7 million settle a class action lawsuit over allegations it failed to provide Fox Sport Net (FSN) or FX programming to subscribers whose packages should have included this programming between Oct. 1, 2010 and Oct. 29, 2010.
If you were a DISH Network subscriber and you paid for a programming package in October 2010 that included FSN and/or FX programming and you did not receive a credit equal to the value of the programming between Oct. 1 and Oct. 29, 2010, you may be entitled to benefits from the DISH Network class action settlement.
Plaintiff Mike Padberg initially filed the DISH Network class action lawsuit on Jan. 25, 2011. In it, he alleges DISH Network breached its contract with its subscribers by failing to provide a monetary credit to subscribers equal to the value of the FSN and/or FX programming that was not provided in October 2010.
DISH filed a motion to dismiss the Fox programming class action lawsuit and was successful in having some of Padberg’s claims dismissed. Padberg filed an amended Dish Network class action lawsuit on Aug. 30, 2012, asserting claims for breach of contract and breach of the covenant of good faith and fair dealing.
DISH Network denies the allegations and maintains it was not contractually obligated to provide the FSN and FX programming. The company says it provided substitute programming from Oct. 1, 2010 through Oct. 29, 2010 equal to the value of the FSN and FX channels that were not provided during this period.
In addition to providing cash benefits to eligible Class Members, DISH Network has also agreed to change its customer contract for at least a two-year period after the class action settlement’s effective date.
Class Members who would like to opt out of or object to the DISH Network settlement must do so no later than April 23, 2018.
Who’s Eligible
Class Members of the DISH Network settlement include all current and former DISH Network subscribers who paid for a programming package for all or part of October 2010 that included Fox Sport Net and/or FX programming and who did not receive a credit equal to the value of such programming when DISH failed to provide it from Oct. 1, 2010 through Oct. 29, 2010.
Potential Award
AT120+ customers who are current DISH subscribers are eligible to receive either:
- A $3 cash payment, or
- A $5 account credit when they upgrade core programming, add a qualifying new premium package, or add or upgrade DISH protect (NOTE: To receive this benefit, the Class Member must elect the credit on the Settlement Website by the Claim Form deadline, upgrade or add the programming or service within 30 days of the DISH class action settlement’s effective date, and retain the upgrade or addition for at least 60 days after the settlement’s effective date.
AT120+ customers who are no longer DISH subscribers are eligible to receive either:
- A $3 cash payment, or
- A $5 credit toward re-signing with DISH as long as they elect the credit on the Settlement Website by the Claim Form deadline, re-sign with DISH within 30 days of the DISH class action settlement’s effective date, and provide the offer code (listed on the Settlement Website) during the sales call to reestablish DISH Network service.
Proof of Purchase
Class Members must provide the 8-digit Claimant ID number that appears on the settlement notice that was mailed or emailed to them.

I’m a Dish Network customer and I would have loved it’s taking longer than normal to get information about the class action suit I would have loved to get information sooner than now about the class action suit so that I could have submitted my name I do have further questions if you could send me an email with the information
Dish is something we can live without without . Thay don’t treat their customers very well ,Down with DISH !
