Property owners who suffered damage related to a Windsor Window can claim benefits from a recent class action settlement.

This Windsor Windows class action settlement resolves claims brought by 15 named plaintiffs in several different class action lawsuits against defendants Windsor Window Company and Woodgrain Millwork Inc.

The plaintiffs say they purchased windows from the defendants’ Pinnacle and Legend product lines that were defectively made. The defects allegedly led to water damage in the windows themselves and the structures in which the windows were installed.

The plaintiffs originally brought these claims in seven separate class action lawsuits, which were later consolidated into a single multidistrict litigation, or MDL.

Windsor Windows and Woodgrain Millwork deny the plaintiffs’ claims and maintain that their windows are not defective. The companies agreed to this class action settlement to avoid the expense and risk of continued litigation.

The settlement provides Class Members with cash payments and replacement products, depending on the type of damage they experienced. Class Members must have suffered damage to qualify for benefits.

Class Members must submit a claim to get settlement benefits. Claims may be submitted by mail or email, or through the settlement website.

Class Members can opt out of the settlement by submitting a written request no later than April 16, 2018. Any Class Members who want to object to the settlement must file their objections by May 7, 2018.

Who’s Eligible

The settlement Class includes all previous, current or subsequent owners of a structure with “Qualifying Windows,” as that term is defined in the settlement agreement.

Qualifying Windows are windows within the Pinnacle and Legend product lines manufactured by Windsor between Jan. 1, 2000 and Jan. 5, 2018. Legend Series windows include Legend Hybrid windows manufactured by Windsor.

A window that was factory-mulled by Windsor and installed in a single opening is considered a single qualifying window. (Mulling is a process that connects two windows together so that they can be placed in a single opening.)

The settlement website has a page devoted to Qualifying Windows and Damages to help potential claimants determine if they have a Qualifying Window. Persons who aren’t sure whether they are a Class Member are invited to consult the settlement website or call the settlement administrator.

Class Membership by itself does not qualify a person for benefits. To qualify for benefits, Class Members must have suffered damage to a window or to the surrounding structure.

Potential Award

Up to $2,500.

The Windsor Window class action settlement provides a variety of benefits. Qualifying Class Members may receive a window sash replacement, a cash payment to compensate for damage to a window frame, cash payment of up to $2,500 to compensate for “Additional Damage” (damage to the structure adjacent to the window), and reimbursement for prior repairs.

Proof of Purchase

In addition to the Claim Form, Class Members must provide:

  • Proof of ownership of the Qualifying Structure (the building where the qualifying window is installed), such as a deed, mortgage statement, or tax bill;
  • Photographs of each window the Class Member is making a claim for, showing the proper product information label and the window ID. Instructions for creating a window ID are in FAQ 34 on the settlement website;
  • Photographs showing all qualifying damage being claimed, labeled with the window ID;
  • Photographs showing the address of the Qualifying Structure – e.g., photos of the house number on the front of the building or on the curb;
  • Exterior photos of each side of the house that contains a window subject to the claim; and
  • Documentation of repair costs already paid or bona fide estimates.

    Hello – I just found this page after searching for whether this is a widespread problem. I have dozens of Windsor windows that are showing severe wood rot, it’s going to cost me a fortune to get this fixed. Please let me know if there’s any way to speak to someone regarding this issue.

    Does anyone know if this has been settled yet? I turned in all the necessary photos and paperwork by the deadline LAST January (2019) and have yet to hear anything on the results.

    We turned in all of our paperwork on our damaged pella windows many months ago after receiving a post card about the settlement! We haven’t heard from anyone and we were just wondering what to do! We have cathedral ceilings wall to wall windows and they leak and are rotting away! Hope you can help! I’ve made phone calls with no success! Thank You!!
