A $700,000 class action settlement has been reached, resolving claims that Tommie Copper copper-infused clothing doesn’t relieve pain as advertised.

Consumers who bought a Tommie Copper product between April 11, 2011 and Dec. 19, 2017 may qualify to receive benefits from this settlement.

This Tommie Copper settlement is the result of two consolidated class action lawsuits, one filed by plaintiff George Potzner and the other by plaintiffs William Lucero, Rhonda Boggs, Jerome Jeffy and Sandy Kontura.

The five plaintiffs challenged Tommie Copper’s representations that its athletic clothing made from copper-infused fabric could help relieve pain.

“Defendants represent that the Tommie Copper Products will purportedly, among other benefits: relieve pain, including arthritis and other chronic joint and muscular pain; aid in injury management; accelerate or speed muscle and joint recovery; and improve muscular power, strength, and endurance,” the Tommie Copper class action states.

Tommie Copper infomercials featured celebrity endorsers who claimed the products relieved the pain associated with an array of different medical conditions. These celebrity endorsers included co-defendant Montel Williams, who suffers from multiple sclerosis.

The plaintiffs argued these claims were completely false. They accused Tommie Copper of fraudulently representing these products to induce them and Class Members to purchase these products and pay a premium for them.

U.S. District Judge Analisa Torres granted preliminary approval of the Tommie Copper settlement in December 2017. The settlement requires Tommie Copper to pay $700,000 into a fund that will be distributed among Class Members who submit valid and timely claims.

This fund will also be used to pay taxes and tax expenses, cost of administering the settlement, class counsel’s attorney fees and costs, and incentive awards for the class representatives.

Class Members must submit a Claim Form to get benefits. Larger payments are available for Class Members who can document their qualifying purchases with purchase receipts.

Class Members can exclude themselves from the settlement or object to the settlement’s terms by submitting a written request no later than March 19, 2018.

Who’s Eligible

Class Members include persons who purchased Tommie Copper copper-infused clothing and compression wear products directly from Tommie Copper, whether online, by phone, or at the Tommie Copper retail location in Westchester, N.Y., between April 11, 2011 and Dec. 19, 2017. Clothing covered by this settlement includes:

  • Crew Compression Socks
  • Calf Compression Socks
  • Back Braces
  • Men’s Long Sleeve Compression Shirts
  • Women’s Long Sleeve Compression Shirts
  • Women’s Compression Tights
  • Wrist Compression Sleeves
  • Ankle Compression Sleeves
  • Calf Compression Sleeves
  • Elbow Compression Sleeves
  • Knee Compression Sleeves
  • Men’ s Compression Under-Shorts
  • Women’s Compression Shorts
  • Men’s Compression Shirts
  • Women’s Compression Shirts
  • Half Finger Compression Gloves
  • Full Finger Compression Gloves
Potential Award

$10 per product.

Class Members can receive a payment of $10 for every Tommie Copper product they purchased for which they can provide a purchase receipt.

Those who submit a valid and timely claim without purchase receipts and instead substantiate their claim with an affidavit may receive a total payment of $5. Claims without proof of purchase are limited to two per household.

Class Members can receive a 40 percent enhancement bonus if they use their cash award toward an online purchase of Tommie Copper products.

Proof of Purchase

Proof of purchase is not necessary to make a claim, but claims documented with a proof of purchase will qualify for greater benefits than those made without proof of purchase. Class Members who do not submit proof of purchase will need to substantiate their claims using a signed affidavit.

UPDATE 2: June 2018, according to the settlement website, payments are expected to be mailed out by the end of the month. The settlement administrator notes that “in the final ruling, the court modified the settlement agreement to limit reimbursement to a maximum of five products (see here). Due to the large number of claims, we anticipate payments to be in the vicinity of $1 per product.”

    Your claims was rejected. Unfortunately the settlement only covers direct purchases from Tommie Copper, and does not include Walmart purchases.
