NRG Residential Solar Solutions LLC, a company that sells and installs solar panels for residential use, has agreed to pay $7 million to settle a class action lawsuit accusing it of violating the Telephone Consumer Protection Act (TCPA) by using prerecorded and/or autodialed calls to advertise residential solar panel systems, including making such calls to numbers listed on the National Do Not Call Registry.
If you received a call regarding the sale or lease of a residential solar panel system by NRG Residential, you may be entitled to benefits from the TCPA class action settlement.
If approved, this proposed TCPA class action settlement will resolve allegations that NRG Residential violated the Telephone Consumer Protection Act by using prerecorded and/or autodialed calls to advertise residential solar panel systems, and that the company violated the TCPA by calling telephone numbers registered on the National Do Not Call Registry.
According to the NRG Residential class action lawsuit, these calls were made directly or through third-party lead generators.
Plaintiff Michael Dobkin alleges that NRG “called large numbers of consumers simultaneously and without human intervention, often just to distribute robotic messages using artificial or prerecorded voices.”
“Making matters worse, many of these calls were made to numbers listed on the National Do Not Call Registry (which is a national database that exists for the sole purpose of avoiding the unwanted calls exactly like those alleged here),” the NRG Residential class action lawsuit says.
“Others were made to private cellphones. Ultimately, none of the telemarketing calls were placed with the prior express consent of the call recipients.”
NRG Residential denies any wrongdoing but agreed to pay $7 million to settle the TCPA class action lawsuit and avoid the burden and expense of ongoing litigation.
Approximately 317,000 Class Members may be eligible for benefits from the NRG Residential class action settlement.
If you would like to opt out of or object to the NRG Residential class action settlement, you must do so no later than Feb. 20, 2018.
Who’s Eligible
Class Members of the NRG Residential TCPA settlement include individuals in the United States who received a telephone call regarding the sale or leasing of a residential solar panel system and whose name and contact information was offered as a “lead” by a lead generator.
NOTE: To be eligible for benefits from this TCPA class action settlement, your name must appear on a list in NRG Residential’s records of leads offered by lead generators.
Potential Award
Class Members who submit timely and valid Claim Forms are entitled to a pro rata share of the $7 million settlement fund. The amount each claimant will receive depends on the total number of valid claims received.
