Employees of Flowers Baking Company and related businesses can now claim payments from a recent wage and hour settlement worth $1.2 million.

Plaintiff Rodney Robinson alleges that hourly employees of various companies doing business under the name Flowers Baking Company were owed outstanding unpaid wages. Certain employees were allegedly required to put on and take off work clothing and gear while they were off the clock.

As a result, Robinson claims, Flowers Baking Company owed employees unpaid straight time, gap time and overtime wages. His wage and hour class action lawsuit raised claims under the federal Fair Labor Standards Act and the employment laws of several states.

Flowers Baking Company denies Robinson’s claims and insists it has not done anything unlawful. The court has made no decision as to liability, and the settlement does not require Flowers Baking Company to admit fault.

The settlement requires Flowers to pay $1.2 million dollars. This fund will be distributed among qualifying Class Members who submit valid and timely claims. It will also be used to cover service awards for the class representative and the first opt-in-plaintiff, as well as class counsel’s attorney fees and court costs.

The named class representative and the first opt-in plaintiff are asking the court to approve a service award worth a total of $10,000.

There are 872 known Class Members, according to the settlement agreement. Class Members must submit a Claim Form to receive payment. Claim Forms may be submitted online or via mail. Settlement checks will be void after 180 days. Class Members will be responsible for any tax liability related to their payments.

Class Members who prefer to opt out of the settlement or object to its terms must do so no later than Feb. 24, 2018.

Who’s Eligible

The settlement Class includes:

  • All current and former hourly employees of Flowers Baking Company of Lenexa LLC, Flowers Baking Company of Denton LLC, Holsum Bakery of Tolleson LLC, and Holsum Bakery Inc. who were not covered by the terms of a collective bargaining agreement at any time between Sept. 30, 2013 and March 22, 2017; and
  • All current and former hourly employees of Alpine Valley Bread Company who worked at any time between March 1, 2016 and March 31, 2017.
Potential Award

Individual payments will be determined in part by the number of weeks the Class Member worked within the relevant time period. Each Class Member’s individualized Claim Form has a field showing that Class Member’s projected payment.

Proof of Purchase

No additional documentation is necessary, other than the Claim Form itself. The online Claim Form requires a CPT ID and Passcode provided on the Class Member’s mailed notice.

      Did you ever receive your check? We made a claim in the time allotted and never received a check. When we asked about it they said “it was sent and never returned” so you should have cashed it in the time allotted.
