Some Essure users have chosen to file lawsuits over these problems against the device’s manufacturer, Bayer Healthcare, alleging that the company failed to adequately warn the public and the medical community about the risks of some of the more severe problems with Essure implants.
Background of the Essure Device
Essure is a permanent birth control device, and was designed as an alternative for women who wanted their birth control to be permanent, but did not want to undergo surgical tubal ligation. Essure was first approved by the U.S. Food and Drug Administration (FDA) in 2002. Since then, it has rapidly increased in popularity. So far, around 750,000 patients have been implanted with Essure.
So what exactly is this device? Essure is made up of two small metal coils and lined with a thin fabric material. The implantation of Essure is an outpatient procedure, and can even be done in a doctor’s office. The implantation is simple: the metal coils are placed in the patient’s fallopian tubes with no incision and no required anesthesia.
Once the Essure procedure is over, it takes a few months for the coils to become effective. Over the course of these months, the coils are allowed to expand, and the surrounding tissue begins to grow in around the device, working together to block the fallopian tubes.
Despite the popularity of the device, lawsuits claim that there are actually some serious problems with Essure implants. Women claim that they chose Essure, expecting a simple and low-risk device, but have ended up suffering from a variety of serious problems with Essure implants.
Problems With Essure Implants
Many patients who were implanted with this device claim that problems with Essure implants are actually more harmful reasonable expectation allows. So far, the U.S. Food and Drug Administration (FDA) reports having received over 5,000 reports of patients suffering from serious problems with Essure implants.
More minor problems with Essure implants have been reported, including things like headaches, dizziness, vomiting, cramps, abdominal or back pain, fatigue, weight fluctuation, and pain during sex, and these are more common problems. There are more major problems with Essure implants as well, including implant failure, device migration, organ perforation, device fracture, and ectopic pregnancy.
Some patients who have suffered from these kinds of problems with Essure implants have required removal surgery to alleviate symptoms, but removal surgery can carry its own risks, such as infection, further injury, and of course the additional medical expense.
Filing a Lawsuit Over Problems with Essure Implants
According to lawsuits, Bayer Healthcare failed to adequately warn patients and the medical community about major problems with Essure implants, choosing to actively withhold this information. Plaintiffs allege that, had they been adequately informed of these problems with Essure implants, they would never have been implanted with an Essure device in the first place, and would have chosen a safer alternative.
If you or someone you love has suffered from any of these problems with Essure implants, you may be able to file a Bayer lawsuit. While filing a lawsuit cannot take away the pain and suffering caused by problems with Essure implants, it can help to compensate for the financial cost of medical expenses and lost wages.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
