A $354 million class action settlement was approved by a federal judge to settle a class action lawsuit alleging International Paper and two other companies schemed to hike the price of containerboard products.

Direct purchasers of containerboard products from International Paper, Temple-Inland, and Weyerhaesuer can claim part of the settlement; however, the settlement amount could change depending on the amount another defendant, Georgia-Pacific, agrees to pay as part of a separate settlement.

Containerboard products include linerboard, corrugated medium, rollstock corrugated sheets and corrugated products, including displays, boxes and other containers. Those who purchased containerboard products directly from any of the class action defendants between between Feb. 15, 2004 and Nov. 8, 2010 can file a claim.

The class action settlement ends a complex set of antitrust claims. Direct purchasers of containerboard, including a floor care products company and a food company, alleged that various producers colluded to extract high prices from direct purchasers.

In 2014, a co-defendant to the class action, Packaging Corp., agreed to pay $17.6 million to exit the class action.

International Paper, Temple-Inland, and Weyerhaesuer do not admit liability under the terms of the settlement.

“While plaintiffs believe that their case is strong, any complex antitrust litigation is inherently costly and risky, and this settlement greatly mitigates that risk and protects the class,” noted the plaintiffs in the proposed settlement agreement. “In addition to a monetary payment, the settlement will provide additional benefits to the members of the class, including cooperation from the settling defendants as provided in the settlement agreement, intended to help streamline trial.”

The containerboard price-fixing class action settlement received final approval on Oct. 17, 2017.

Who’s Eligible

Direct purchasers of containerboard products from any of the defendants in the class action lawsuit, including International Paper, Temple-Inland, Weyerhaeuser, WestRock, Georgia-Pacific, Packaging Corporation of America, and Cascades Canada. Purchases need to have been made between Feb. 15, 2004 and Nov. 8, 2010.

Potential Award

Varies depending on amount of containerboard purchased between Feb. 15, 2004 and Nov. 8, 2010.

Proof of Purchase

Proof of purchase documentation indicating the total purchases for which claims will need to be submitted along with supporting documentation including the product name, number of units, date of purchase, defendant purchased from, and net purchase amount.

    Ah so the consumer gets hosed yet again.

    We paid higher prices due to higher packaging costs… but naturally don’t get any of the money.
