This RCN Telecom Services settlement resolves a TCPA class action lawsuit that accused the telecommunications provider of violating the Telephone Consumer Protection Act by placing automated calls using a predictive dialer and an automated telephone dialing system that featured a prerecorded or artificial voice.

These calls were allegedly made for business reasons such as scheduling installation appointments, providing service appointment reminders, or to collect on an alleged debt.

According to plaintiff Eric Seal, many of these calls were placed to the cell phones of consumers who were no longer RCN customers. Instead, the calls were allegedly placed to cell phone numbers of former RCN customers that had been terminated and the numbers reassigned to consumers with no business relationship to RCN.

Seal also claimed that RCN violated the TCPA by making more than one marketing call in a 12-month period to numbers that were registered on the National Do Not Call Registry.

The Telephone Consumer Protection Act is a federal law that prohibits the use of an automatic telephone dialing system to make calls to cell phones without the consent of the recipient. The TCPA also prohibits making prerecorded calls or marketing calls to landlines if the phone number is listed on the National Do Not Call Registry.

TCPA violations are subject to a $500 penalty per violation, or $1,500 per willful violation of the TCPA.

RCN did not admit liability for the alleged TCPA violations but agreed to pay $5 million to settle the TCPA class action lawsuit. Under the terms of the TCPA class action settlement, RCN agreed to pay Class Members a maximum of $140 per valid claim.

Class Members of the TCPA settlement generally include anyone who, between April 1, 2011 and Nov. 1, 2016, received a phone call from or on behalf of RCN without providing consent.

The RCN class action settlement was granted final approval on Feb. 24, 2017.

The deadline to file a claim for the RCN Telecom Services class action settlement passed on March 15, 2017.
