Hydroxycut Supplements Class Action Settlement Checks Mailed

Top Class Actions viewers say they are receiving checks in the mail from the Hydroxycut class action settlement resolving claims that the company falsely marketed its dietary supplements.

According to comments and posts on the Top Class Actions Facebook page, Class Members who submitted valid claims for the Hydroxycut class action settlement on time received checks worth as much as $28 starting on Dec. 11, 2017.

The Hydroxycut class action lawsuit alleged that Iovate Health Services Sciences USA manufactured and sold Hydroxycut by making false and misleading claims about its effectiveness.

Plaintiff Daniel Garcia said he relied on those false and misleading claims when he decided to purchase Hydroxycut products made by Iovate.

The plaintiff alleged that the company violated California’s consumer protection and advertising laws as well as the Magnuson-Moss Warranty Act.

The class action claimed that Iovate duped consumers out of money and was unjustly enriched by the false advertising of Hydroxycut dietary supplements.

Iovate agreed to pay up to $8 million to settle the class action lawsuit. Under the terms of the settlement, Iovate denies the allegations and said that the company is settling to avoid the expense of future litigation. Class members could receive a full refund with proof of purchase or up to $14 per bottle for up to two bottles of Hydroxycut without proof of purchase.

Class Members included individuals who purchased one or more bottles of Hydroxycut-brand products in the United States for personal use between May 2, 2009 and Feb. 15, 2017. Hydroxycut products include:

Class Members had until May 30, 2017, to file a valid claim, exclude themselves, or object to the Hydroxycut class action settlement.

Iovate has also agreed to remove certain statements about Hydroxycut from its labeling and provide additional disclosures about the dietary supplement to consumers.
