A $7.5 million class action settlement will provide payments to Missouri CenturyLink customers who purchased a Pure Broadband internet service package.
Plaintiff Kyle Sanford filed this CenturyLink class action lawsuit over the marketing of CenturyLink’s “Pure Broadband” package in Missouri. The Pure Broadband package allegedly did not consist of only broadband internet service but also included a limited-use phone line.
As a result, customers who purchased the Pure Broadband package just for the internet service allegedly had to pay certain surcharges associated with the use of a phone line. These surcharges included the nationwide Universal Fund Surcharge, a Missouri Universal Service Fund Surcharge, a 911 Surcharge, and a Missouri Relay Surcharge.
Sanford claims CenturyLink marketed this mixed-use package in violation of the Missouri Merchandising Practices Act.
After negotiations and an all-day mediation session in August, the parties finally signed off to this CenturyLink class action settlement in October 2017. The settlement requires CenturyLink to pay $7.5 million into a settlement fund. This fund will first be used to pay for a $15,000 incentive payment to Sanford for serving as class representative, class counsel’s attorneys’ fees and court costs, and the costs of settlement administration.
The remaining balance will be used for payments to qualifying settlement Class Members who submit valid and timely claims. Each Class Member will receive a payment representing a percentage of the surcharges they paid during the time they were Pure Broadband subscribers.
CenturyLink continues to deny Sanford’s claims and admits no liability by entering into this settlement. The company says it has agreed to this settlement to avoid the costs and risks that would come with prolonging the litigation. The court has made no determination as to liability.
Class Members wishing to exclude themselves from the settlement or object to its terms must do so in writing no later than Dec. 26, 2017.
Who’s Eligible
Class Members include persons who between Dec. 3, 2007 and July 31, 2017 purchased the Pure Broadband package and no other telephony services from CenturyLink in the state of Missouri and were assessed a Universal Service Fund Surcharge, a Missouri Universal Service Fund Surcharge, a 911 Surcharge, or a Missouri Relay Surcharge.

Individual payments to qualifying Class Members will cover a percentage of the federal and Missouri universal service charges they paid while they were a Pure Broadband customer. The percentage will be the amount of the settlement fund left over after covering the plaintiff’s incentive award, court costs and attorney’s fees, and settlement administration costs, divided by $5,718,000.

In addition to the other information requested on the Claim Form, Class Members must provide their unique Class Member ID number, provided on their settlement notice postcard.

I filed a claim before the March 8, 2018 deadline and have a claimant ID number how do I find out if this has been settled and if I will get my proceeds.
I live in Missouri & have had Centurylink for over 40 years, family too, because that’s the “only” phone service you get in Southeast Missouri. My internet has always had problems & still does. & spectrum ( for last 25 years is the only other provider! PLEASE add me to the list, I have phone records all the way back to 1975!
They sold me on high-speed 25mh plus purchase of a new router! And after thinking I have high speed come to find out it is only 10mh
Rain, sun or snow I have trouble
I don’t live in Missouri but for the heck of it, (I have CenturyLink – Pure Broadband) just now I found an old phone, plugged it into a phone jack and guess what??!! I have a dial tone! I never was informed that my broadband Internet ONLY included a phone line! No wonder I pay just a bit under $100 a month! Hmmm…and by the way, I live in Arkansas.
I never received a postcard, but have had CenturyLink internet for over ten years. Is there any way to find out why I didn’t get a postcard??
I lived in centurylinks territory until december 2009 and tried to file a claim using the phone number i had when i was a customer and it wont let me. I never recieved a post card with unique id because of moving and they would have no way to track me down. So only customers that were cheated that are still customers can file a claim. is this correct?
I live in MT & recieve Century link. Being in MT does that gualify me for the settlement? They do not tell subscribers it is less expensive to buy the modem. Nor do they tell anyone about the hidden charges.
