DePuy ASR Hip Implant Failure Sparks Lawsuits
Johnson & Johnson agreed to pay a combined $600,000 to settle three DePuy ASR hip implant failure lawsuits brought about by patients who had undergone painful revision surgery. They had experienced pain, bone damage and other side effects from the metal parts.
Each patient received around $200,000, but attorneys say that is at the low end of the spectrum. Metal hip implant class action lawsuits may award up to $500,000 per patient, according to legal experts’ estimations.
DePuy based its ASR hip implant system on a predecessor, the Pinnacle hip implant system. The Pinnacle’s metal-on-metal system allegedly resulted in metal poisoning (metallosis), indicated by a dangerous release of toxic metal ions into the nearby tissue and bloodstream. Even though the ASR was based on the Pinnacle, only the ASR has been recalled.
The DePuy ASR hip implant failures are due to similar problems seen in the patients who have experienced failure with the Pinnacle hip implant system. Tissue death, bone erosion, the tumor development and metal poisoning can cause severe inflammation and pain.
The metal-on-metal parts not only shed metal ions, but also fret away tiny pieces of metal debris that can further irritate and deteriorate nearby bone and tissue.
An internal Johnson & Johnson memo presented in one trial indicated DePuy knew that 40 percent who underwent ASR hip implant surgery would require revision surgery within a mere five years. DePuy allegedly knew the cobalt and chromium could leach into a patient’s body and that metal shavings can be impossible to remove during revision surgery.
