Verified Credentials Inc. has agreed to pay $1.4 million to settle a class action lawsuit accusing it of violating the Fair Credit Reporting Act (FCRA) by reporting public record information in consumer reports that were likely to have an adverse effect on a consumer’s ability to obtain employment without providing notice to the consumer and without ensuring the report was complete and up to date.
If you were the subject of a consumer report sold by Verified Credentials to a third party for employment purposes, you may be entitled to payment from the FCRA class action settlement.
Plaintiff Ashley Moody claims that Verified Credentials provided consumer reports for employment purposes that contained information that was likely to adverse the consumer’s ability to obtain employment. According to the FCRA class action lawsuit, Verified Credentials violated the FCRA by failing to provide notice to the subject of the report and by failing to maintain strict procedures to ensure the information in the consumer report was complete and up to date.
Verified Credentials denies the allegations but agreed to settle the FCRA class action lawsuit to avoid the burden and expense of ongoing litigation.
The Verified Credentials settlement was preliminarily approved on Oct. 24, 2017.
Class Members who would like to opt out of or object to the Verified Credentials FCRA settlement must do so no later than Jan. 27, 2018.
Who’s Eligible
Class Members of the Verified Credentials settlement include all U.S. residents who were the subject of a consumer report sold by Verified Credentials to a third party for employment purposes, whose employment-purposed report contained at least one public record (such as a criminal conviction, civil lien, civil judgment or bankruptcy) that was likely to have an adverse effect on the consumer’s ability to obtain employment and in which no notice pursuant to the FCRA was sent.
The court has certified two subclasses: the Automatic Payments Class and the Opt-In Class:
- Automatic Payments Class Members include consumers who meet the above definition of a Class Member and who disputed the public information contained in the Verified Credentials consumer report, whose dispute resulted in a revised report, and where no notice was sent as required by the FCRA.
- Opt-In Class Members include consumers who meet the above definition of Class Member and where no notice was sent as required by FCRA. Opt-In Class Members must timely opt-in to the Verified Credentials settlement and return a valid Claim Form certifying that they were harmed as a result of the Verified Credentials consumer report being incomplete or not up to date.
Potential Award
The potential award, which will be distributed pro rata, is estimated to be between $19.07 and $256, depending on how many Opt-In Class Members participate.
