An Alabama man recently filed a lawsuit against Atrium Medical Corporation alleging that its C-Qur mesh product caused him to suffer adverse effects and complications.
The plaintiff, Phillip T., was implanted with a C-Qur hernia mesh on Mar. 14, 2013.
However, after the hernia mesh surgery, Phillip suffered adverse effects. He later had the hernia mesh removed and endured multiple surgical procedures.
According to the hernia mesh surgery lawsuit, Phillip suffered adverse effects including permanent disability, disfigurement, physical pain and suffering and emotional distress.
Phillip filed his hernia mesh surgery lawsuit on Nov. 15, 2017 in the U.S. District Court for the District of New Hampshire. The hernia mesh surgery lawsuit was filed on multiple counts, including negligence, design defect, manufacturing defect, failure to warn, breach of express warranty, fraudulent concealment and several others.
Hernia Mesh Surgery Lawsuit Joins Others in MDL
Phillip’s claim is filed as part of a large multidistrict litigation, or MDL, centered on allegations that the C-Qur hernia mesh manufactured by Atrium Medical caused patients to suffer complications and adverse effects requiring them to undergo revision surgery.
Some of the allegations brought against Atrium Medical include manufacturing a defective product and failing to adequately test the hernia mesh.
The allegations also accuse Atrium of having known about the defective mesh and intentionally misrepresenting the quality and safety of the device.
What is a Hernia Mesh?
According to the U.S. Food and Drug Administration (FDA), a hernia may be caused because of a combination of any kind of pressure placed on the abdomen or the weakness or opening of muscle or connective tissue.
Although hernias often occur later in life, muscle weakness can also be present at birth. Because any pressure placed on the abdomen can cause a hernia, some of these causes can include lifting heavy objects, obesity, persistent coughing or sneezing, and constipation or diarrhea.
Hernia mesh surgeries repair damaged muscle walls because it decreases the likelihood of a hernia reoccurrence. A surgical mesh is a medical device that provides extra support.
Types of hernia mesh products also manufactured by Atrium Medical include Vitamesh, Proloop, Prolite and Prolite Ultra. There are also various types of hernia mesh products such as patches, plugs and sheets.
Hernia Mesh Adverse Effects and Complications
The implantation of a hernia mesh device may lead to serious complications. Plaintiffs claim one possible cause of patients’ adverse effects is an Omega-3 fatty acid coating on the C-Qur hernia mesh. This coating has been blamed for life-threatening systemic infections and allergic reactions.
According to the FDA, through analyzed scientific literature and an adverse event database, there is a list categorizing some of the most likely complications to result from a hernia mesh implant.
The FDA says “the most common adverse events following hernia repair with mesh are pain, infection, hernia recurrence, adhesion, and bowel obstruction.” Some other potential side effects, according to the FDA, include mesh shrinkage (contraction) and mesh migration.
Adverse effects and complications following hernia mesh surgery also include:
• Infection
• Tenderness at the implant side
• Organ perforations
• Bowel or intestinal blockage
• Autoimmune reactions to mesh
