The polyurethane foam price-fixing settlements resolve allegations in a consolidated class action lawsuit that the producers of flexible polyurethane foam conspired to raise the prices and allocate the market for foam products.

More than a dozen polyurethane foam manufacturers were named as defendants in the price-fixing class action lawsuit. In April 2014, the court certified a Class of consumers from 29 states and the District of Columbia who indirectly purchased products containing polyurethane foam from the defendants.

The defendants deny the allegations, and the litigation is still pending against some of the companies. Eleven defendants have agreed to settle the class action lawsuit to avoid the burden and expense of ongoing litigation.

The settling defendants include Valle Foam Industries Inc.; Dofoam International Inc.; Carpenter Co.; FFP Holdings LLC; Future Foam Inc.; FXI Holdings Inc.; Hickory Springs Manufacturing Company; Leggett & Platt Inc.; Mohawk Industries Inc.; Vitafoam Products Canada Limited and Vitafoam Inc.; and Woodbridge Foam Fabricating Inc., Woodbridge Foam Corporation, and Woodbridge Sales & Engineering Inc.

Class Members of the polyfoam price-fixing settlement include indirect purchasers who bought (not for resale) any upholstered furniture, carpet underlay or bedding product that contained flexible polyurethane foam that was manufactured in the United States between Jan. 1, 1999 and Aug. 1, 2015 in one of the following states:

  • Alabama
