Top Class Actions viewers are reporting that they have started receiving checks in the mail worth as much as $7.61 from a class action settlement involving allegations that Revlon’s “Age Defying with DNA Advantage” products were falsely advertised.
If you filed a claim for the Revlon DNA Advantage class action settlement, keep an eye on your mailbox because you may soon be receiving a check in the mail!
Plaintiffs Anne Elkind and Sharon Rosen filed the Revlon class action lawsuit in 2014. They claim that the “DNA Advantage” language is misleading because the products in this line of cosmetics do not stimulate, interact with or otherwise affect genetic code in human skin cells.
The plaintiffs claim that reasonable consumers would be misled by the phrase “with DNA Advantage” and would believe the ingredients in the products would be able to interact with the skin’s DNA to reverse, minimize or slow the process of aging.
Revlon Consumer Products Corporation denies that the phrase “DNA Advantage” is false or misleading. It fought against the litigation and attempted to have the DNA Advantage class action lawsuit dismissed. However, its attempts were ultimately unsuccessful. The cosmetics company eventually agreed to settle the Revlon class action lawsuit to avoid the burden and expense of ongoing litigation.
Class Members of the Revlon DNA Advantage settlement include anyone who, between April 25, 2011 and June 30, 2016, purchased Revlon DNA Advantage cream makeup, concealer, or powder within the United States for personal, household or family use and not for resale.
Claimants could file a claim for $3 for each Revlon DNA Advantage item purchased. There was no limit to the number of products that could be claimed as long as the Class Member submitted proof of purchase such as a receipt or product packaging. Class Members who did not submit proof of purchase could claim up to three products.
The deadline to file a claim for the Revlon class action settlement passed on June 5, 2017.
The Revlon DNA Advantage class action settlement received final approval on Aug. 2, 2017.
