A near $8 million class action settlement has been reached which will resolve several class action lawsuits that claim Petco assistant managers were not paid overtime when they worked more than 40 hours in a workweek, which allegedly violated federal and/or state law.
If you worked as an assistant manager at Petco, you may be entitled to payment from the Petco unpaid overtime class action settlement.
The Petco class action lawsuits were filed by former assistant managers who accused Petco Animal Supplies Inc., Petco Holdings Inc., Petco Holdings Inc. LLC and Petco Animal Supplies Stores Inc. of failing to pay them overtime for the hours worked over 40 in a workweek.
According to the Petco class action lawsuits, the plaintiffs and Class Members are entitled to money under the federal Fair Labor Standards Act and/or the laws of Colorado, Illinois, Massachusetts, New Jersey, New York, Oregon, and Pennsylvania.
The first Petco class action lawsuit was filed in March 2013 by plaintiff Erik Kellgren, who claimed he was denied overtime pay because he was allegedly misclassified as exempt from overtime. As his Petco unpaid overtime lawsuit moved through the court system, approximately 475 people filed consents to join the action. Similar Petco class action lawsuits were also filed.
Petco denies the allegations and maintains its pay practices complied with all legal requirements. However, Petco has agreed to settle the unpaid overtime class action lawsuit to avoid the burden and expense of further litigation.
According to the settlement documents, Petco will pay up to $7.995 million to resolve the litigation.
The Petco class action settlement was preliminarily approved on Sept. 27, 2017.
Class Members who would like to opt out or object to the Petco unpaid overtime must do so no later than Dec. 11, 2017.
Who’s Eligible
Class Members of the Petco unpaid overtime settlement include anyone who submitted a consent to join the Kellgren action and who had not withdrawn their consent or had their claims dismissed as of Sept. 27, 2017 or who worked as an assistant manager at a Petco store in the following states:
- Colorado from Jan. 15, 2014 to June 18, 2016;
- Illinois from Nov. 23, 2013 to June 18, 2016;
- Massachusetts from Jan. 31, 2014 to June 18, 2016;
- New Jersey from April 6, 2015 to June 18, 2016;
- New York from April 14, 2010 to June 18, 2016;
- Oregon from Oct. 21, 2014 to June 18, 2016; and
- Pennsylvania from July 14, 2014 to June 18, 2016.
Potential Award
Varies. The amount each claimant will receive depends on the number of weeks worked during the relevant Class Period and the laws governing the claim.
