Mercedes-Benz

Mercedes-Benz talked car owners into subscribing to Tele Aid service without telling them the service would be come obsolete in a few years, according to a class action lawsuit currently pending in federal court. If you owned or leased a 2002 – 2006 Mercedes-Benz vehicle with analog-only Tele Aid equipment after August 22, 2002, your rights could be affected if a settlement is reached.

The Mercedes-Benz Tele Aid class action lawsuit alleges that that the car manufacturer knew or should have known as early as August 22, 2002 that the analog-only Tele Aid equipment included in these vehicles would become obsolete in 2008, but continued to market that equipment without disclosing its would not be useable in the future. The class action claims that class members were persuaded into subscribing to the analog-only Tele Aid service on the belief that the Tele Aid systems would continue to function throughout the vehicles’ useful lives. It wasn’t until class members received letters from Mercedes-Benz in 2006 and 2007 that told them they had to choose between purchasing an equipment upgrade and losing the benefits of Tele Aid that they realized their service would be discontinued in 2008.

The lawsuit is seeking to recover money for all class members, in addition to attorneys’ fees.

Class members in the Mercedes-Benz Tele Aid class action lawsuit include anyone who purchased or leased a 2002-2006 Mercedes-Benz vehicle equipped with an analog-only Tele Aid system after August 22, 2002, and (1) subscribed to Tele Aid service until being informed that the service would be discontinued at the end of 2007, or (2) purchased an upgrade to digital equipment.

You are not included in the class action if you (1) purchased or leased a pre-owned Mercedes-Benz vehicle In December 2006 or thereafter, or (2) leased a Mercedes-Benz vehicle equipped with analog-only Tele Aid equipment, but returned the vehicle to the lessor before losing Tele Aid service.

If you wish to remain a class member in this lawsuit, you do not need to do anything at this time. If you wish to opt out, however, you must submit your request by October 18, 2010.

I recently moved and do not have any information on this lawsuit. I own a 2003
430clk and have the Tele Aid system in my car. I subscribed for a year then realized it was not useful. The equipment is obsolete.

Are there documents I can sign to participate in the lawsuit?

    Thank you,
    Pam
