A class action lawsuit investigation is looking into alleged wage and hour violations conducted against California Praxair delivery drivers.
Praxair is a company that specializes in delivering industrial gases and chemicals to businesses throughout the United States. Because Praxair products are considered dangerous, a Praxair delivery driver must stay with the truck the entire time while on delivery.
This requirement to continuously stay with the truck causes conflicts with federal and state wage and hour laws which require employees including Praxair delivery drivers to receive proper rest and meal breaks. California labor law additionally mandates this requirement.
Meal Breaks and Other Wage and Hour Requirements
Wage and hour laws under the state of California are stricter and offer additional protection for employees than wage and hour laws mandated under federal law. Praxair delivery drivers may fall under the protection of California state wage and hour laws.
California law provides an array of protections to make sure employees get a reasonable amount of break time on the job. If an employee has worked more than 5 hours, 30-minute meal breaks are required. For every 4 hours worked, 10 minute rest breaks are required, and for every 3.5 hours worked a rest break is required.
Employees may be given two 30-minute breaks if more than 10 hours have been worked. Time spent off the clock for employees can be spent in however and whatever way they choose–they cannot be made to work during meal breaks. If a meal break is not given, workers should be compensated for one hour of work.
Although Praxair delivery drivers are not working in the same location each day, they are still entitled and protected under state and federal wage and hour laws. Some changes between the regulations of these laws may be made upon mutual agreement between the employee and employer. Otherwise, meal breaks are and protected right that should be offered to every Praxair delivery driver.
A class action lawsuit investigation is looking into possible wage and hour and meal break violations by Praxair. Former employees who have worked as Praxair delivery driver have initiated the class action lawsuit investigation.
