Plaintiffs Lawrence H. and Kathleen H. are filing legal action against BNSF Railway Co., The Budd Co., Foster Wheeler Corporation, and other companies for allegedly failing to warn the public against potential asbestos exposure in conjunction with their products.

According to this lung cancer and asbestos lawsuit, the couple claims that Lawrence has directly suffered from the effects of lung cancer and asbestos. Lawrence worked fort these companies between 1968 and 2009, during which time he was allegedly exposed to asbestos on a regular basis.

Asbestos was popularly used for different construction and insulation purposes for its chemical and fire resistant qualities. In addition, the material was cheap to use and was an overall ideal choice for different applications.

Its popularity reached peak levels during World War II, when asbestos was used on different Navy vessels. However, this has resulted in numerous United States Navy veterans being exposed to the fibers, with former manufacturing laborers also at risk for long term asbestos health problems.

Lawrence reportedly worked with asbestos products on a daily basis, which were manufactured, sold, distributed, or installed by the defendants named in the asbestos lung cancer lawsuit. Lawrence was reportedly diagnosed with asbestos lung cancer on June 24, 2016, and has since had to contend with the condition.

When asbestos fibers are inhaled or swallowed, they become lodged in the lungs and stomach respectively. From here, a variety of long term health problems can potentially develop after a long dormancy period.

Asbestos lung cancer can take decades before patients begin showing any symptoms because it takes time for asbestos fibers to trigger cancer cells. This often results in late-stage diagnosis, short survival time, and very limited treatment options.

Due to environmental concerns surrounding asbestos, federal regulations are in place requiring companies to provide proper disclosure in case of asbestos danger. In addition, strict abatement procedures must be followed to remove asbestos safely.

During all times relevant, Lawrence was unaware he was working with asbestos products and did not receive any disclosures from the companies.

Lawrence and Kathleen opted to file legal action, alleging the companies either knew or should have known about the alleged correlation between lung cancer and asbestos. The couple is requesting a jury trial and is seeking over $50,000 in damages.
