asbestos close up mesothelioma lung cancerAfter dying with mesothelioma, an asbestos victim’s daughter is seeking compensation from asbestos product manufacturers.

Plaintiff Sally M. has filed a lawsuit against CBS Corporation and several other companies, individually and on behalf of the estate of her mother Mattie S., due to her death caused by asbestos exposure and mesothelioma.

According to the mesothelioma lawsuit, Mattie was a resident and citizen of the state of Wyoming. Her exposure to asbestos in Casper, Wyo. allegedly left her dying with mesothelioma years later, according to Sally.

Mattie died on July 16, 2015 due to her sustained injuries caused by an asbestos exposure.

Mattie had first become diagnosed with mesothelioma on March 18, 2015. The mesothelioma lawsuit alleges that before dying with mesothelioma, she had become exposed to asbestos or asbestos- containing equipment because of the work of her husband, Kermit S.

According to the mesothelioma lawsuit, Kermit had worked as a Boiler Fireman and a Boiler Foreman at Texaco’s Evansville, Wyo. refinery between 1951 and 1982.

“Dust created by working with and around asbestos and asbestos-containing products would permeate the person and clothing of the decedent’s husband,” Sally alleges.

Sally maintains that Mattie would repeatedly become exposed to the asbestos dust from her husband’s person and clothing. Handling Kermit’s clothing exposed Mattie to asbestos enough to leave her dying with mesothelioma, Sally says.

The mesothelioma lawsuit alleges that the presence of asbestos in their products and on their properties increased the likelihood of “causing respiratory diseases, cancer and other health problems to workers or members of such workers’ household who would be exposed to asbestos.”

Sally alleges the defendants did not provide any warnings about the dangerous properties of the asbestos in their products.

The mesothelioma lawsuit states, “Each of the defendants knew, or should have known, that workers such as Kermit … would be exposed to their asbestos products and would go on to expose members of their households, such as decedent Mattie … to their asbestos.”

Sally’s complaint raises claims for two counts of strict liability and negligence.

Asbestos and Mesothelioma Facts

Mesothelioma is a tumor of the tissue that lines the stomach, lungs, heart, or any other organ in the body. It can be treated but not cured, and thousands of people die from mesothelioma each year. It is a rare condition, with fewer than 20,000 cases occurring each year.

Physicians who diagnose mesothelioma have said that they diagnose approximately 3,000 people annually. These physicians often trace a mesothelioma asbestos diagnosis to job related exposure. An asbestos-related disease may not appear until decades after asbestos exposure.

Some of the symptoms of mesothelioma may include chest pain, a cough, shortness of breath, unusual lumps of tissue beneath the skin, and unexplained weight loss.
