kid-taking-pillTop Class Actions viewers are reporting that they are receiving checks in the mail from a class action settlement over allegations that the fluoride content in certain chewable fluoride tablets was overstated.

If you filed a claim for the fluoride tablet class action settlement, keep an eye on your mailbox because you may soon be receiving a check!

According to comments and posts on the Top Class Actions Facebook page, settlement checks reportedly started arriving on Oct. 23, and the highest amount received so far by a viewer is $57.88.

The fluoride chewable tablet settlement resolves a class action lawsuit filed in 2015 which alleges defendants Endo Health Solutions Inc., Endo Pharmaceuticals Inc., Generics International (US Parent) Inc., Generics International (US) Inc., and Vintage Pharmaceuticals LLC misrepresented the amount of fluoride contained in certain chewable fluoride tablets.

Plaintiff Shannon Mahoney alleged that the chewable tablets contained just 44 percent of the fluoride ion claimed on the package label and insert.

“Defendants misrepresented the true dosage of Qualitest products for years and deceived millions of parents, dentists, and pediatricians as to the amount of fluoride being delivered to children,” Mahoney stated in the fluoride tablet class action lawsuit.

Mahoney claimed the Qualitest Multi-Vitamin with Fluoride Chewable Tablets were no more effective than a placebo, and that the amount of fluoride they contain is far lower than the medically-recommended dosage.

The defendants deny the allegations but agreed to pay $15.5 million to settle the fluoride tablet class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members of the chewable fluoride tablets settlement include anyone who, between Oct. 31, 2007 and Dec. 31, 2015, paid for Qualitest Pharmaceuticals, Vintage Pharmaceuticals or Physicians Total Care branded multivitamins with fluoride chewable tablets which purportedly contained 1 mg, 0.5 mg or 0.25 mg doses of fluoride.

Consumer Class Members and Third-Party Payor Class Members were eligible to file claims for the chewable fluoride tablet settlement.

The deadline to file a claim for the chewable fluoride tablets class action settlement passed on April 17, 2017. Proof of purchase was not required unless the Class Member was submitting a claim for more than $250.

The fluoride chewable tablets class action settlement received final approval on June 23, 2017.

    Just found my kids’ checks under a pile of papers – ranging from $2.36 to $14.61. I was about to deposit them but noticed that it said they are void if not cashed within 60 days. It’s been about 67 days. Am I just out of luck?
