California Telebrands Inc. customers who took advantage of a “buy one, get one free” offer can benefit from a $300,000 class action settlement.

Plaintiff Regis Greenwood filed this Telebrands class action lawsuit in October 2014, alleging defendant Telebrands lured consumers into buying products using a false advertising scheme.

According to Greenwood, Telebrands offered a deal under which consumers could get a “bonus” or “free” product in conjunction with the purchase of another product. But consumers who took Telebrands up on that offer allegedly ended up paying fees for processing, handling and shipping.

Greenwood argues this offer is unlawfully deceptive and misleading. His Telebrands class action lawsuit raises claims for violations of California’s False Advertising Law. This law forbids businesses from offering customers a “free” gift on the condition that the customer must pay for shipping in excess of the average cost of postage or the exact cost of shipping. The law also forbids charging an unreasonable or excessive fee for handling.

Telebrands does not admit any liability by agreeing to this settlement and continues to deny Greenwood’s claims.

Under terms of the settlement, Telebrands will create a $300,000 settlement fund to be distributed to Class Members who file valid and timely claims. To get a payment, Class Members must submit a Claim Form to the settlement administrator. Payments will come in check form and delivered via U.S. Mail.

The fund will also cover class counsel’s costs and attorney fees, and an incentive award for Greenwood. In addition to paying into the settlement fund, Telebrands must also cover the costs of settlement administration.

If the claims received add up to $50,000 or less, Telebrands will pay the difference between the claims amount and $50,000 to a charity chosen by both parties. Any fund amounts left over after covering Class Member payments and any charitable donations will revert to Telebrands.

Class Members can exclude themselves from the settlement or object to the settlement’s terms by filing a written request no later than Oct. 16, 2017.

Who’s Eligible

Members of the settlement Class include all persons in California who between Oct. 16, 2010 and Dec. 1, 2011 purchased a product from Telebrands sold with an offer of a “free” or “bonus” product in connection with that purchase.

Class Members who submit valid and timely claims may receive payments as large as $5. That amount may be reduced, depending on the number of claims received.

        I would like a claim form for Telebrands. Can Not Download. This is due to 2 products that I ordered years ago that were false advertisements & had unnecessary fees associated with the advertisement.

    the administrators offer the option of filing a claim online or by mail, by downloading a claim form, then neglect to provide the means of downloading a claim form, really good job by a dubious administrator!
