Purchasers who had trouble with a warranty claim for their Motorola smart watches or cell phones can now claim benefits from a recent class action lawsuit.
This Motorola class action lawsuit was filed in April 2016 by plaintiff Douglas Lynch. Lynch claims his Motorola 360 smart watch suffered a cracked back-plate less than a year after he purchased it.
He says he sent the watch to Motorola for replacement. After several weeks of delays and mixed messages, he eventually received an inferior replacement watch, he claims. Lynch ultimately gave up trying to get a correct replacement from Motorola and purchased a new watch from a competitor manufacturer.
Lynch says many other Motorola customers have had a similarly fruitless experience trying to get the company to honor its own warranty. He claims the company subjects customers to a runaround of calls, emails and broken promises until they eventually give up.
Under terms of the Motorola class action settlement, Class Members can claim various benefits depending on the type of trouble they had with their warranty claims. Motorola has also pledged to implement several customer-friendly improvements in the way it processes warranty claims.
Class Members can object to the settlement or exclude themselves from it by submitting a written request by Dec. 6, 2017.
Who’s Eligible
The settlement creates an Injunctive Relief Class and a Damages Class.
The Injunctive Relief Class covers all U.S. persons who purchased a Motorola cell phone or smart watch between Nov. 1, 2012 and Aug. 14, 2017 and have submitted a valid warranty claim for device repairs within the remaining warranty period.
The Damages Class covers all persons who submitted their device for repairs under a valid warranty claim between Nov. 1, 2012 and Aug. 14, 2017 and meet at least one of the following criteria:
- An Advance Exchange Program security deposit was charged but was never released;
- Motorola failed to ship a replacement device within 10 days of receiving the Advance Exchange Program Fee;
- Motorola failed to ship a repaired or replacement device within 20 days of receiving the original device; or
- The device owner never received a repaired device, a replacement device, or a refund.
Potential Award
Varies.
Monetary compensation is available for Damages Class Members. These Class Members can receive:
- Reimbursement of Advance Exchange Program fees, if Motorola failed to ship them a replacement device within 10 days of receiving those fees;
- Repayment of any security deposit funds held by Motorola in connection with a return under the Advanced Exchange Program, if Motorola received the damaged device within 20 days of shipping the replacement device;
- A replacement device and a $20 cash payment, if the Class Member never received a repaired or replacement device and was not credited with a refund.
Damages Class Members to whom Motorola did not ship a replacement device within 20 days of receiving the defective device will receive a payment of $15. Those to whom Motorola did not ship a replacement within 30 days will receive a payment of $20.
For Injunctive Relief Class Members, Motorola will take several steps to improve its warranty claim service, including by increasing its call representatives’ authority to grant credits for Motorola’s own errors.

Sad to see that they still refuse to honor their warranty or provide decent customer service as of 2021. You’d think they’d want to avoid another lawsuit.
How about their Motorola One XT1941-3?
SUPPOSED to be unlocked for the gsm network like AT&T & TMobile but they truly are not.
So as far as I am concerned, I was given information they knew was false

Purchased watch at best buy in 2016,days before Christmas as gift for spouce, watch quite so sent it in never received correspondence or watch back it was Moto 360, cost me over 300.
Many of the Samsung 8 $700.00 phones are having trouble with speaker?we can hear the other party but they hear intermittent voice or cuts out completely. We hear them clearly. Called Samsung they vaguely tried to pin point the issue, until they found out the provider is straight a division of Verizon. They said straight is responsible for the phone. REALLY did straight build these over priced phones that quit working and put customers at risk? What about kids staying in touch with parents, or elderly that could be injured and can’t be heard due to these rotten phones. We need to look into the issues because there are lots of complaints being expressed online. All Samsung 8 and same issue I have intermittent or no way to respond to person on the other end of call.
