group of soldiersSome members of the United States military have been injured by roadside bombs while on duty. Now these individuals may qualify to file an anti-terrorism lawsuit against some financial institutions who have allegedly provided funds to states who sponsor terrorism.

Section 2333 of the Anti-Terrorism Act, which was added as civil remedy provision in 1992, allows victims of terrorism to seek financial restitution from banking institutions who have contributed to funding acts of terrorism.

This part of the Anti-Terrorism Act states, “Any national of the United States injured in his or her person, property, or business by reason of an act of international terrorism, or his or her estate, survivors, or heirs, may sue therefore in any appropriate district court of the United States and shall recover threefold the damages he or she sustains and the cost of the suit, including attorney’s fees.”

A landmark anti-terrorism lawsuit in 2008, Boim v. Holy Land Foundation for Relief and Dev., found that family members of a victim who was injured in a roadside shooting by Hamas were able to hold an organization based in Texas responsible because they helped to raise funds for Hamas.

If a person files an anti-terrorism lawsuit, the lawsuit is civil and not criminal. This type of anti-terrorism lawsuit is filed against a bank, organization or other type of financial institution that can be found to have given money to or helped to finance any international terrorist group.

Additionally, banking institutions that have been involved in money “laundering,” or concealing the origins of money that has been obtained illegally and transferring that money through the institution, can be found liable in this type of anti-terrorist lawsuit.

If an organization has given financial help or engaged in money laundering with Hezbollah, Iranian Revolutionary Guard Corps, Iran’s Qods Force, Shia Terrorist Organizations or Sunni Terrorist Organizations, they may be held liable by the families of victims who have suffered terrorist acts.

Military veterans who have been injured by Explosively Formed Penetrators (EFP), Improvised Explosive Devices (IED) or Improvised Rocket-Assisted Munitions (IRAM) and their families may be eligible to file an anti-terrorist lawsuit against any financial institution that has helped fund terrorist groups.
