The device is at the heart of thousands of lawsuits concerning the DePuy ASR hip recall.

The DePuy ASR hip implant has been at the center of a massive recall, including settlements for patients who have undergone a hip revision surgery as of March 2015.

Moreover, adverse effects and complications have led to several consumers requiring hip revision surgery. Patients who have been implanted, then required hip revision surgery from the implantation of the DePuy ASR hip replacement system, may be eligible to file a claim.

Reported complications include, but are not limited to: metallosis, or the release of cobalt and chromium particles from the hip replacement system into the bloodstream or nearby tissue; cobalt poisoning; loss of bone strength or structure, which may result in a bone fracture; non-cancerous tumors, or pseudotumors that develop around the hip implant; cancer; cardiomyopathy, or degenerative heart disease; dislocated hip, and failure of the hip replacement system requiring revision surgery.

As a result of the alleged complications, the U.S. Food and Drug Administration (FDA) announced in August 2010 a voluntary recall of DePuy ASR products. The products included a recall of approximately 93,000 DePuy ASR hip implants around the world. Of these, moreover, 73,000 products included were in the U.S.

The recall was a result of data released by the UK joint registry which discovered and found that 13 percent of DePuy ASR hip implants require hip revision surgery to correct debilitating complications. These debilitating complications are those side effects suffered by patients who have been implanted with the DePuy Pinnacle hip replacement or any other metal-on-metal hip replacement device.

The ASR Hip Implant Settlement

The manufacturers of the DePuy ASR XL Acetabular System and DePuy Pinnacle Acetabular Cup System, Johnson & Johnson, have entered into an ASR hip implant settlement after thousands of metal-on-metal hip lawsuits being filed against them. Roughly 8,000 metal-on-metal hip replacement lawsuits have been filed.

Accordingly, Johnson & Johnson has agreed to an ASR hip implant settlement concerning its first lawsuits pertaining to the DePuy ASR XL Acetabular System. In August 2012, an ASR hip implant settlement by Johnson & Johnson reached a combined settlement of $600,000 to settle three lawsuits filed against J&J alleging severe complications from the metal-on-metal hip implant insertion.

These three patients, moreover, had the hip implant system removed after suffering from alleged complications including pain, bone damage, and other side effects.

Each plaintiff of the first ASR hip implant settlement received approximately $200,000. Class attorneys estimate ASR hip implant settlement may yield individual settlement payments anywhere between $200,000 and $500,000.
