Johnson & Johnson and subsidiary DePuy Orthopaedics are facing a growing multidistrict litigation (MDL), consisting of patients alleging they needed Pinnacle revision surgery soon after getting the company’s metal hip implant.
One of the newest DePuy Pinnacle hip lawsuits comes from a South Carolina couple alleging the defective nature of the company’s metal hip implant had caused the wife to need Pinnacle revision surgery.
Plaintiff couple Dorothy G. and Joseph G. allege Pinnacle revision surgery was needed after Dorothy had allegedly experienced serious metal hip implant complications. According to the DePuy Pinnacle hip lawsuit, Dorothy underwent total left hip replacement surgery on June 28, 2006.
The Pinnacle hip implant used an Ultamet 36 mm metal-on-metal insert, and was marketed to be a safe and long lasting option for orthopedic patients, according to the couple’s complaint.
Overview of DePuy Pinnacle Hip Lawsuit
Not long after having the device implanted, Dorothy began experiencing serious metal hip implant complications including blood metal poisoning and tissue death surrounding the implants. In addition, Dorothy had reportedly began experiencing pain and difficult moving.
These complications came to a head in September 2015, when diagnostic work was ordered to determine how much damage had been done. Her bloodwork indicated high levels of chromium and cobalt, with doctors ordering her to undergo Pinnacle revision surgery.
According to the high volume of FDA injury reports, blood metal poisoning is not a rare occurrence and may be a result of design flaws. When the all-metal ball and socket joints interact, metal ions can be shed into the body and can cause a multitude of problems including:
- Device Failure
- Corrosion
- Fretting
- Formation of Pseudotumors
- Debilitating Pain
These complications often force patients to undergo revision surgery in order for these injuries can be corrected. Dorothy’s Pinnacle revision surgery occurred on March 22, 2016, and she is currently contending with the recovery process. Dorothy opted to file legal action after discovering a number of other patients underwent Pinnacle revision surgery for similar metal hip implant complications.
Dorothy claims that she was unable to make this discovery sooner and had relied upon the company’s marketing materials when agreeing to the Pinnacle hip implant. According to the research conducted for the DePuy Pinnacle lawsuit, there have been over 1,300 injury reports submitted to the FDA regarding Pinnacle hip implant failures.
Dorothy is filing this DePuy Pinnacle hip lawsuit in MDL No. 2244, where it will stand alongside similar claims alleging similar injuries. Each of these claims are filed by DePuy Pinnacle patients or their loved ones who suffered serious metal hip implant complications and had to undergo Pinnacle revision surgery.
By joining an MDL, Dorothy’s claim will be streamlined through the litigation process and avoid issues like conflicting rulings from different judges. Dorothy states that she would not have agreed to use the metal hip implant if she had known about the likelihood of Pinnacle revision surgery.
