Roundup Cancer gardening MonsantoPlaintiff James S. has filed a lawsuit in Missouri federal court against Monsanto Company, the manufacturers of Roundup weed killer.

According to the Roundup lawsuit, the plaintiff alleges that he suffered adverse effects and complications due to his exposure to the product and its active glyphosate ingredient. He allegedly developed non-Hodgkin’s Lymphoma because of his exposure.

The lawsuit contends that “Roundup and/or glyphosate is defective, dangerous to human health, unfit and unsuitable to be marketed and sold in commerce, and lacked proper warnings and directions as to the dangers associated with its use.”

According to the Roundup and lymphoma lawsuit, James had not known of the role of glyphosate in possibly causing cancer, particularly non-Hodgkin’s lymphoma, throughout his use of the product.

James is a resident and citizen of Polk County, Florida. He contends that he sustained his injuries and was exposed to the alleged dangerous active  ingredient glyphosate while he sprayed athletic fields, playgrounds, and other property while working as a maintenance supervisor for a school.

Specifically, the plaintiff endured injuries and became diagnosed with non-Hodgkin’s lymphoma (NHL) due to the alleged use of Roundup. He was diagnosed with NHL in September 2013.

His wife, Cathleen S., also files suit alleging that because of her husband’s injuries she has suffered from “loss of comfort, enjoyment, society, and services of her spouse” from which she had been entitled to receiving.

The Monsanto Company had begun to produce its product containing glyphosate in 1974, branding it Roundup. By 2007, consumption of the product in the U.S. had reached 185 million pounds, and by 2013, it was the most widely used herbicide throughout the world.

Roundup and Lymphoma Facts

According to reports, glyphosate is the active ingredient in Roundup that is linked to the development of non-Hodgkin’s Lymphoma. There are also, however, other cancers being linked to the ingredient. Some of these include: Leukemia, Multiple Myeloma, Bone Cancer, Skin Tumors, Pancreatic Islet Cell Tumors, and B-Cell Lymphoma.

In a report released by the International Agency for Research on Cancer (IARC) in March 2015, it reported a correlation associating glyphosate with cancer. Other studies have also reached the same conclusion.

One study, a Canadian study conducted in November 2001, stated in an article entitled “Cancer, Epidemiology, Biomarkers & Prevention” and published in the American Association for Cancer Research that “men exposed to glyphosate were developing non-Hodgkin’s Lymphoma after being exposed to the chemical for under 10 years.”

A Swedish study, published in the International Journal of Cancer in October 2008, also reported finding a link between glyphosate and cancer, reporting that in less than 10 years of exposure to glyphosate, the risk of developing non-Hodgkin’s Lymphoma doubled.

In a separate study, published in the Occupational and Environmental Medicine journal, researchers concluded that glyphosate was “potentially carcinogenic” and was “associated with increased NHL [non-Hodgkin’s Lymphoma] incidence.”

The Roundup and Lymphoma Lawsuit is Case No. 4:17-cv-02302-NCC, in the U.S. District Court for the Eastern District of Missouri.
