IED attack EFP attack anti-terrorism act lawsuitThe family of a late servicemember killed in the Iraq war in 2007 by an explosively-formed penetrator (EFP), a particularly vicious weapon capable of breaching the heavy metal of an armored tank, are suing the banks they believe made the attack possible. The EFP attack lawsuit was initiated by the parents of Shawn Dressler, who would have been 33 years old this summer if he had lived.

The Dressler family have grieved for the loss of their son for the last ten years, but decided to take legal action when they heard of other families that had won a favorable judgement three years ago in an EFP attack lawsuit against a financial institution.

According to a story posted on azcentral, Shawn Dressler, then 23, was on his second deployment to Iraq when he was killed along with another soldier. The incident occurred when the side of their Humvee was compromised while they were patrolling the city of Baghdad. The piercing weaponry was an EFP, allegedly made in Iran and bankrolled by unnamed foreign banks.

According to the family’s EFP attack lawsuit, a comprehensive terror campaign against U.S. was sustained by the involvement of many foreign banks willing tobankroll terrorist activity initiated by the government of Iran. Iran was then able to provide parts for EFPs and two other types of weaponry known as improvised explosive devices (IEDs) and Improvised Rocket-Assisted Munitions (IRAMs).

An IED is often what is used in a roadside bomb, as they contain their own detonating device. IEDs have been responsible for over 60% of deaths in the Iran war and in the Afghanistan war to date. IRAMs are rocket-propelled explosive-filled propane tanks frequently launched by remote control from the back of what may look like an abandoned truck or other vehicle.

The country was also able to provide training in using the deadly equipment against U.S. service people. Without the interruption a lack of funds would have caused, allegedly terrorist cells in Iraq led by members of Iran’s Islamic Revolutionary Guard were able to carry out numerous attacks on American servicemembers.

According to the family of Shawn Dressler, their EFP attack lawsuit includes the complaints of about 100 other victims and their families. It employs consideration under a law known as the Foreign Sovereign Immunities Act which allows civil lawsuits against foreign sponsors of terrorism. The first target of the lawsuit is of course, the country of Iran – where there were factories making these weapons in large quantities as reported in the media.

Congress had put sanctions in place that allegedly prevented Iran from sponsoring or engaging in terrorism, but it was ineffective because it really did nothing more than eliminating a funding source. But according to the plaintiffs in these EFP attack lawsuits, there were several profit-generating financial institutions willing to step into the gap and help the country with their funding issues.

Prior legal actions have resulting in guilty pleas and settlement offers from Commerzbank in Germany, BNP Paribas of France and HSBC of the UK. While the country of Iran itself has ignored EFP attack lawsuit allegations, hope remains to get other financial giants to accept their responsibility in the deaths of hundreds of U.S. servicemembers.
