When a patient is in need of a hip replacement, he or she expects that that implant will last a couple decades. However, recipients of the DePuy ASR hip implant may find that their implants do not last that long. In 2010, DePuy issued a recall for its ASR hip systems due to high rate of failure.

DePuy ASR Hip System and Complications

The DePuy ASR hip implant is a medical device that uses a metal-on-metal ball and socket system. ASR refers to Articular Surface Replacement. These hip implant systems were among the most widely used hip systems in the early 2000s.

The DePuy ASR systems were intended to be more durable than previous models and were marketed to a younger, more active patient. It promised greater range of motion and increased endurance for the patient who wanted to be active and still enjoy life as before.

This hip replacement system was to be used in hip resurfacing surgeries. Resurfacing retains more natural hip structure than other hip implant surgeries.

But these metal-on-metal ASR hip systems made by DePuy came with many complications. In metal-on-metal implants, metal shards can form when the metal parts rub or collide into one another. These metal shavings are released into the surrounding tissue and blood at the implant site, which induces a condition known as metallosis, or metal poisoning.

Additionally, non-cancerous cysts, tissue infection, device failure, dislocation of the hip implant, the calcification of soft tissue, hip infection and the loss of bone around the replacement have also been reported as ASR hip implant complications.

In some litigation proceedings, it was discovered that Johnson & Johnson estimated that some 40 percent of ASR patients would need revision surgery within five years.

Revision surgery to repair or replace a hip implant is often riskier than the original surgery and may come with additional complications.

DePuy ASR Hip Replacement Settlement

Many patients who have experienced complications with their hip implants have sought a DePuy ASR hip replacement settlement through litigation.

Almost 10,000 people have pursued a DePuy ASR hip replacement settlement. In the Ohio multidistrict litigation (MDL) for these claims, 9,939 lawsuits were gathered. Many have been settled, but there are still some that remain. In this MDL, the first bellwether trials occurred in 2013.

In response, DePuy has agreed to spend more than $4 billion in a DePuy ASR hip replacement settlement to resolve many of these lawsuits. This DePuy ASR hip replacement settlement affects those who have undergone revision surgery before August 31, 2013.

Later, in March 2015, DePuy set aside an additional $420 million in a DePuy ASR hip replacement settlement agreement to cover another 1,800 lawsuits.
